01 "An Act relating to telecommunications services in a competitive market; and providing                                  
02 for an effective date."                                                                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 42.05 is amended by adding a new section to read:                                                 
05            Sec. 42.05.433.  Telecommunications services in a competitive market.  (a)                                 
06       A local exchange carrier operating in a competitive market is not subject to retail tariff                        
07       filing requirements and is exempt from the following provisions of this chapter:                                  
08       AS 42.05.361, 42.05.371, 42.05.381, 42.05.391, 42.05.411, 42.05.421, and 42.05.431.                               
09            (b)  In this section,                                                                                        
10                 (1)  "competitive market" means an entire service area or communities                                   
11       within a service area specifically identified by the commission                                                   
12                      (A)  served by two or more local exchange carriers; or                                             
13                      (B)  where the commission has designated two or more eligible                                      
14            telecommunications carriers;                                                                                 

01                 (2)  "eligible telecommunications carrier" means a telecommunications                                   
02       utility eligible under 47 U.S.C. 214(e) (Federal Communications Act), as amended by                               
03       the Telecommunications Act of 1996 (P.L. 104-104);                                                                
04                 (3)  "local exchange carrier" means a carrier certificated to provide                                   
05       local telephone services;                                                                                         
06                 (4)  "retail" means services or products sold directly to the actual user                               
07       of the services or products.                                                                                      
08    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
