01 "An Act adding birthing centers to the list of health facilities eligible for payment of                                
02 medical assistance for needy persons."                                                                                  
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 47.07.900(11) is amended to read:                                                                 
05                 (11)  "health facility" includes a hospital, skilled nursing facility,                                  
06       intermediate care facility, intermediate care facility for the mentally retarded,                                 
07       rehabilitation facility, inpatient psychiatric facility, home health agency, rural health                         
08       clinic, [AND] outpatient surgical clinic, and birthing center;                                                
09    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
10 read:                                                                                                                   
11       CONTINGENT EFFECT.  AS 47.07.900(11), as amended by sec. 1 of this Act, takes                                     
12 effect only if the United States Department of Health and Human Services provides to the                                
13 state an amount equal to or greater than one half of the cost of medical assistance coverage for                        
14 medical services at birthing centers on or Before January 1, 2007.
