01 "An Act relating to sex trafficking and tourism."                                                                       
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 11.66 is amended by adding new sections to read:                                                  
04                        Article 4.  Sex Trafficking.                                                                   
05            Sec. 11.66.400.  Sex trafficking.  (a)  A person commits the crime of sex                                  
06       trafficking if the person recruits, entices, harbors, transports, provides, or obtains a                          
07       person, or benefits from the recruitment, enticement, harboring, transportation,                                  
08       provision, or obtaining of a person to engage in a commercial sex act and the person is                           
09                 (1)  less than 18 years of age at the time the person was recruited,                                    
10       enticed, harbored, transported, provided, or obtained; or despite age,                                            
11                 (2)  forced, coerced, or fraudulently induced to engage in a commercial                                 
12       sex act by                                                                                                        
13                      (A)  threats of physical injury to, or physical restraint against                                  
14            that person or another person;                                                                               
15                      (B)  means a scheme, plan, or pattern intended to cause the                                        

01            person to believe that if the person did not perform or continue to perform                                  
02            commercial sex acts that person would suffer physical injury or physical                                     
03            restraint;                                                                                                   
04                      (C)  abuse or threatened abuse of the law or legal process; or                                     
05                      (D)  threats of physical injury to, or physical restraint of that                                  
06            person or another person or by means of any scheme, plan, or pattern leading a                               
07            person to believe that they or another person would suffer physical injury or                                
08            physical restraint if that person or another person did not enter into the status                            
09            or condition of a debtor arising from a pledge by the debtor of his or her sexual                            
10            personal services or those of a person under his or her control as a security for                            
11            debt.                                                                                                        
12            (b)  In this section, "commercial sex act" means any sex act for which anything                              
13       of value is given to or received by any person.                                                                   
14            (c)  Sex trafficking is a class A felony.                                                                    
15            Sec. 11.66.410.  Sex tours and tourism.  (a)  A person commits the crime of                                
16       sex trafficking if the person                                                                                     
17                 (1)  organizes, arranges, sells, or advertises travel services or facilitates                           
18       travel to any place whatsoever for the purpose of a person's engaging in a commercial                             
19       sexual act with a person whose participation in a commercial sex act is the product of                            
20       any act or activity prohibited in AS 11.64.400;                                                                   
21                 (2)  organizes, arranges, sells, or advertises tourism packages or                                      
22       activities using and offering sexual acts as enticement for tourism; or                                           
23                 (3)  provides or purports to provide access to or to facilitate the                                     
24       availability of sexual services with a person whose participation in such acts is the                             
25       product of any act or activity prohibited in AS 11.64.400.                                                        
26            (b)  In this section, "commercial sex act" has the meaning given in                                          
27       AS 11.66.400.                                                                                                     
28            (c)  A person convicted under this section is guilty of a class A felony.
