00 SENATE CS FOR CS FOR HOUSE BILL NO. 83(FIN) 01 "An Act relating to the Alaska Seismic Hazards Safety Commission; and providing for 02 an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.37.065(b) is amended to read: 05 (b) The commission is composed of 11 [NINE] members appointed by the 06 governor for terms of three years. [A MEMBER HOLDS OFFICE UNTIL A 07 SUCCESSOR IS APPOINTED.] A vacancy is filled for the unexpired term. 08 * Sec. 2. AS 44.37.065(c) is amended to read: 09 (c) The governor shall appoint to the commission 10 (1) a representative from the University of Alaska; 11 (2) three representatives, each [A REPRESENTATIVE] from a local 12 government in a separate seismically active region of the state; 13 (3) a representative from the Department of Natural Resources; 14 (4) a representative from the Department of Military and Veterans'

01 Affairs; 02 (5) a representative from an appropriate federal agency; 03 (6) a representative of the insurance industry; and 04 (7) three members from members of the public who are expert in the 05 fields of geology, seismology, hydrology, geotechnical engineering, structural 06 engineering, emergency services, or planning. 07 * Sec. 3. AS 44.37.069 is amended by adding new paragraphs to read: 08 (4) "seismic hazard" means an earthquake-induced geologic condition 09 that is a potential danger to life and property; in this paragraph, "geologic condition" 10 includes strong ground shaking, landslide, avalanche, liquefaction, tsunami 11 inundation, fault displacement, and subsidence; 12 (5) "tsunami" means a large ocean wave produced by an earthquake, 13 landslide, or volcanic eruption. 14 * Sec. 4. AS 44.66.010(a)(9) is amended to read: 15 (9) Alaska Seismic Hazards Safety Commission (AS 44.37.065) - 16 June 30, 2012 [2005]. 17 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 18 read: 19 APPOINTMENT OF MEMBERS; TERM OF OFFICE. (a) The governor shall 20 appoint 11 members to the Alaska Seismic Hazards Safety Commission. 21 (b) Notwithstanding AS 44.37.065(b), as amended by sec. 1 of the Act, four members 22 appointed by the governor shall serve terms of four years, four members shall serve terms of 23 three years, and three members shall serve terms of two years. 24 (c) A person who is a member of the commission immediately before the effective 25 date of this Act 26 (1) shall hold office until the effective date of an appointment to that office 27 under (a) of this section; and 28 (2) may be reappointed by the governor for a term in (b) of this section. 29 * Sec. 6. This Act takes effect immediately under AS 01.10.070(c).
