00 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 20 01 "An Act relating to a separate appropriation bill for operating expenses for primary 02 and secondary public education and establishing a date by which the bill must be 03 transmitted to the governor each year; relating to notice of nonretention for tenured 04 teachers; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 14.17 is amended by adding a new section to read: 07 Sec. 14.17.302. Appropriations for funding public education. The 08 governor shall, before the fourth legislative day of each regular session, submit to the 09 legislature a separate appropriation bill limited to appropriations to carry out 10 AS 14.17.400 - 14.17.490 for the succeeding fiscal year. The legislature shall, by 11 March 15 of each year, pass and transmit to the governor a bill making appropriations 12 to carry out AS 14.17.400 - 14.17.490 for the succeeding fiscal year. 13 * Sec. 2. AS 14.20.140(a) is amended to read: 14 (a) If a teacher who has acquired tenure rights is to be laid off under

01 AS 14.20.177 or is not to be retained for the following school year, the employer shall 02 notify the teacher of the layoff or nonretention by writing, delivered before March 25 03 [16], or by registered mail postmarked before March 25 [16]. 04 * Sec. 3. AS 37.07.020(a) is amended to read: 05 (a) The governor shall prepare a budget for the succeeding fiscal year that 06 must cover all estimated receipts, including all grants, loans, and money received from 07 the federal government and all proposed expenditures of the state government. The 08 budget shall be organized so that the proposed expenditures for each agency are 09 presented separately. The budget must be accompanied by the information required 10 under AS 37.07.050 and by the following separate bills: (1) an appropriation bill 11 authorizing the operating and capital expenditures of the state's integrated 12 comprehensive mental health program under AS 37.14.003(a) and an appropriation 13 bill funding public education under AS 14.17.400 - 14.17.490; (2) an appropriation 14 bill authorizing state operating expenditures other than those included in the state's 15 integrated comprehensive mental health program or in the bill funding public 16 education under AS 14.17.400 - 14.17.490; (3) an appropriation bill authorizing 17 capital expenditures other than those included in the state's integrated comprehensive 18 mental health program; and (4) a bill or bills covering recommendations, if any, in the 19 budget for new or additional revenue. The budget for the succeeding fiscal year and 20 each of the bills shall become public information on December 15, at which time the 21 governor shall submit copies to the legislature and make copies available to the public. 22 The bills, identical in content to the copies released on December 15, shall be 23 delivered to the rules committee of each house before the fourth legislative day of the 24 next regular session for introduction. 25 * Sec. 4. This Act takes effect July 1, 2005.
