00 CS FOR HOUSE BILL NO. 16(RLS) 01 "An Act relating to funding for school districts operating secondary school boarding 02 programs, to funding for school districts from which boarding students come, and to the 03 effectiveness of district secondary school boarding programs; and providing for an 04 effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 14.16 is amended by adding a new section to read: 07 Article 2. School Districts Operating Boarding Programs. 08 Sec. 14.16.200. State funding for districts operating secondary school 09 boarding programs. (a) A district that began operating a secondary school boarding 10 program before January 1, 2005, is eligible to receive reimbursement for the costs 11 incurred by the district in operating that program. To be eligible for reimbursement 12 for costs, the district secondary school boarding program must provide a suitable 13 student dormitory licensed under AS 47.35.015(h) and daily access to a public school 14 offering the appropriate grade level.

01 (b) Costs that may be claimed by a district for reimbursement under (a) of this 02 section are 03 (1) one round trip between the student's community of residence and 04 the school during the school year if the district expends money for the trip; and 05 (2) a per-pupil stipend determined by the department on a regional 06 basis. 07 (c) In this section, 08 (1) "district" has the meaning given in AS 14.17.990; 09 (2) "district secondary school boarding program" means a public 10 school operated for a full school year by a district in which domiciliary services are 11 provided for students in grades nine through 12. 12 * Sec. 2. AS 14.17.905 is amended by adding a new subsection to read: 13 (c) Notwithstanding (a)(1) of this section, a community with an ADM of less 14 than 10 shall be counted as a school if the ADM would be at least 10 if each student 15 from the community who is enrolled in a district secondary school boarding program 16 outside of the student's community and operated under AS 14.16.200 were counted as 17 a student in the community. 18 * Sec. 3. AS 14.16.200 and AS 14.17.905(c) are repealed July 1, 2010. 19 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 20 read: 21 REPORT ON SECONDARY SCHOOL BOARDING PROGRAMS. Not later than 22 February 1, 2010, the department shall provide to the governor a report on the effectiveness of 23 the district secondary school boarding programs operated by school districts. The department 24 shall include draft legislation to extend the cost reimbursement under AS 14.16.200 and the 25 student counting method under AS 14.17.905(c) for boarding school programs if the 26 department finds that continuation of the programs is in the best interest of the state. The 27 department shall make the report available to the public and to the legislature. 28 * Sec. 5. This Act takes effect July 1, 2005.
