00 SENATE BILL NO. 379 01 "An Act providing that public members of the Board of Trustees of the Alaska 02 Permanent Fund Corporation may be removed only for cause; and providing for an 03 effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 37.13.070(a) is amended to read: 06 (a) The governor may remove a public member of the board from office only 07 for cause, including inefficiency, neglect of duty, misconduct in office, or because 08 the member while serving on the board is convicted of a misdemeanor or felony 09 involving moral turpitude. The grounds for [A] removal by the governor must be 10 in writing and must state the reason for the removal. The member shall be given an 11 opportunity to be heard in person or through counsel at a public hearing before 12 the governor or a designee upon at least 10 days' notice. The member may 13 confront and cross-examine adverse witnesses. A member who is removed by the 14 governor may not participate in board business and may not be counted for purposes

01 of establishing a quorum after the member receives written notice of removal from the 02 governor. Upon removal, the governor or a designee shall file in the office of the 03 lieutenant governor the findings and a complete statement of all grounds for 04 removal asserted against the member. 05 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 06 read: 07 APPLICABILITY. This Act applies to public members of the Board of Trustees of 08 the Alaska Permanent Fund Corporation appointed under AS 37.13.050 09 (1) on or after the effective date of this Act; or 10 (2) before the effective date of this Act, and serving in that capacity on the 11 effective date of this Act. 12 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
