00 SENATE BILL NO. 313 01 "An Act making supplemental and other appropriations; amending appropriations; 02 making an appropriation to capitalize a fund; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. DEPARTMENT OF ADMINISTRATION. The sum of $3,447,647, resulting 05 from the settlement agreement with Alaska Communication Services, is appropriated from the 06 general fund to the information services fund (AS 44.21.045(a)). 07 * Sec. 2. EXXON VALDEZ OIL SPILL RESTORATION FUND. (a) The legislature 08 finds that 09 (1) as a result of the judgment entered by the United States District Court in 10 the criminal case United States of America v. Exxon Shipping Company and Exxon 11 Corporation, No. A90-015 CR, the state received $50,000,000 in restitution "to be used by 12 the State of Alaska . . . exclusively for restoration projects, within the State of Alaska, 13 relating to the 'Exxon Valdez' oil spill"; 14 (2) the money received by the state in restitution is held in the Exxon Valdez

01 oil spill restoration fund, established by the Department of Revenue to implement the 02 judgment; and 03 (3) the appropriation in (b) of this section is made in order to achieve the 04 purposes set out in the court's restitution order described in (1) of this subsection. 05 (b) The sum of $100,000 of the unappropriated and unobligated balance of income 06 accrued on or before June 30, 2004, in the fund described in (a)(2) of this section is 07 appropriated to the Department of Law for the fiscal years ending June 30, 2004 and June 30, 08 2005, for the purposes of restoring, replacing, or enhancing resources or services injured or 09 lost as a result of the Exxon Valdez oil spill through analysis of continuing injury from the oil 10 spill and development of restoration options. 11 * Sec. 3. DEPARTMENT OF FISH AND GAME. Section 131, ch. 139, SLA 1998, page 12 48, lines 13 - 15, is amended to read: 13 APPROPRIATION GENERAL OTHER 14 ITEMS FUND FUNDS 15 Juneau Indoor Shooting 1,575,000 1,575,000 16 Range and Hunter Education [1,500,000] [1,500,000] 17 Facility Construction (ED 3-4) 18 * Sec. 4. OFFICE OF THE GOVERNOR. The sum of $180,000 is appropriated from the 19 general fund to the Office of the Governor, division of elections, for improving accessibility 20 to voting locations for the fiscal year ending June 30, 2004. 21 * Sec. 5. DEPARTMENT OF HEALTH AND SOCIAL SERVICES. (a) The sum of 22 $3,500,000 is appropriated to the Department of Health and Social Services for the state 23 veterans' home conversion in Palmer from the following sources: 24 General fund match $ 459,200 25 Federal receipts 2,275,000 26 Alaska Student Loan Corporation dividend 765,800 27 (b) The amount of RPL 06-4-0028, which was reviewed by the Legislative Budget 28 and Audit Committee at its July 9, 2003, meeting is reduced by $3,334,000 in federal 29 unrestricted receipts expenditure authorization from the Department of Health and Social 30 Services, Alaska Senior Assistance Program, for the fiscal year ending June 30, 2004. 31 (c) The sum of $3,334,000 in federal unrestricted receipts expenditure authorization is

01 appropriated to the Department of Health and Social Services, division of public assistance, 02 senior care program, for the fiscal year ending June 30, 2004. 03 (d) The sum of $154,000 is appropriated from the general fund to the Department of 04 Health and Social Services, division of public assistance, senior care program, for the fiscal 05 year ending June 30, 2004. 06 (e) The sum of $162,800 is appropriated from the general fund to the Department of 07 Health and Social Services for the senior care program for the fiscal year ending June 30, 08 2004, and is allocated as follows: 09 (1) Alaska longevity programs management $46,000 10 (2) Health purchasing group 85,000 11 (3) Public assistance administration 25,000 12 (4) Public assistance data processing 6,800 13 * Sec. 6. DEPARTMENT OF NATURAL RESOURCES. (a) The sum of $300,000 is 14 appropriated from receipt supported services to the Department of Natural Resources, 15 recorder's office, for increased workload and operating costs for the fiscal year ending 16 June 30, 2004. 17 (b) The sum of $150,000 is appropriated from the general fund to the Department of 18 Natural Resources, office of habitat management and permitting, for operating costs for the 19 fiscal year ending June 30, 2004. 20 (c) Section 1, ch. 82, SLA 2003 page 32, lines 17 - 19, is amended to read: 21 APPROPRIATION GENERAL OTHER 22 ITEMS FUND FUNDS 23 Remote Recreational Cabins 549,000 549,000 24 Survey and Appraisals [430,000] [430,000] 25 (ED 99) 26 * Sec. 7. DEPARTMENT OF PUBLIC SAFETY. 01 and Improvements 02 [- CONSTRUCTION PHASE] (ED 1) 03 * Sec. 8. DEPARTMENT OF REVENUE. (a) The sum of $300,000 is appropriated from 04 permanent fund corporation receipts to the Department of Revenue, Alaska Permanent Fund 05 Corporation, for additional operating costs for the fiscal year ending June 30, 2004. 06 (b) In accordance with AS 15.13.145(b), the Alaska Permanent Fund Corporation 07 (1) may use money appropriated by (a) of this section and by sec. 1, ch. 83, 08 SLA 2003, p. 31, lines 8 - 9, to advocate to the legislature and members of the public in favor 09 of passage of a resolution submitting to the voters a constitutional amendment relating to a 10 method of calculating distributions from the Alaska permanent fund; and 11 (2) if the resolution passes the legislature, may also use the appropriated 12 money to advocate for adoption of the constitutional amendment by the voters. 13 * Sec. 9. DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES. (a) 14 The sum of $200,000 is appropriated from the International Airports Revenue Fund 15 (AS 37.15.430) to the Department of Transportation and Public Facilities, Anchorage airport 16 administration, for Concourse C tenant improvement inspection expenses for the fiscal year 17 ending June 30, 2004. 18 (b) The sum of $1,500,000 is appropriated from the International Airports Revenue 19 Fund (AS 37.15.430) to the Department of Transportation and Public Facilities, Anchorage 20 airport facilities, for the planning and implementation of a consulting services contract, and 21 projected maintenance costs for Concourse C, for the fiscal year ending June 30, 2004. 22 (c) The sum of $10,000,000 is appropriated from Adak airport operations, federal 23 receipts, to the Department of Transportation and Public Facilities for a five-year contract to 24 meet mobilization requirements and improvements, and to provide immediate and long-term 25 operation and maintenance of the Adak air field. 26 * Sec. 10. DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES 27 FEDERAL PROJECTS. LAPSE OF APPROPRIATIONS. (a) The appropriation made by sec. 1 of this 12 Act is to capitalize a fund and does not lapse. 13 (b) The appropriations made by secs. 5(a), 9(c), and 10(a) of this Act are for capital 14 projects and lapse under AS 37.25.020. 15 * Sec. 12. CONTINGENT EFFECT AND CONTINGENT EFFECTIVE DATE. (a) 16 Sections 5(b), 5(c), 5(d), and 5(e) of this Act take effect only if a bill is passed by the Second 17 Session of the Twenty-Third Alaska State Legislature and is enacted into law that establishes 18 a senior care program in the Department of Health and Social Services and that has an 19 effective date of June 30, 2004 or earlier. 20 (b) If secs. 5(b), 5(c), 5(d), and 5(e) of this Act take effect under (a) of this section, 21 they take effect immediately under AS 01.10.070(c), or on the effective date of the Act 22 described in (a) of this section that establishes a senior care program, whichever is later. 23 * Sec. 13. Except as provided in sec. 12 of this Act, this Act takes effect immediately under 24 AS 01.10.070(c).
