01 "An Act relating to access to library records, including access to the library records of a                             
02 child by a parent or guardian."                                                                                         
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 40.25.140 is amended to read:                                                                   
05            Sec. 40.25.140.  Confidentiality of library records.  (a)  Except as provided                            
06       in (b) and (c) of this section, the names, addresses, or other personal identifying                           
07       information of people who have used materials made available to the public by a                                   
08       library shall be kept confidential, except upon court order, and are not subject to                               
09       inspection under AS 40.25.110 or 40.25.120.  This subsection [SECTION] applies to                             
10       libraries operated by the state, a municipality, [OR] a public school, including the                              
11       University of Alaska, and by a public library nonprofit corporation.                                          
12            (b)  Records of a public elementary or secondary school library identifying a                                
13       [MINOR] child under 18 years of age shall be made available on request to a parent                            
14       or guardian of that child.                                                                                        

01    * Sec. 2.  AS 40.25.140 is amended by adding a new subsection to read:                                             
02            (c)  Records of a library operated by the state, a municipality, the University of                           
03       Alaska, or by a public library nonprofit corporation identifying a child under 16 years                           
04       of age who is unemancipated shall be made available to a parent or guardian of that                               
05       child.
