00 SENATE BILL NO. 234 01 "An Act relating to secondary student competency testing and to school performance 02 designations; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 INTENT. It is the intent of this Act to delay for two years the implementation of the 07 high school graduation examination requirement and the school accountability process if the 08 level of funding for public education is reduced from the amount of funding available in fiscal 09 year 2003. 10 * Sec. 2. AS 14.03.123(a) is amended to read: 11 (a) Beginning in September 2006 [2004], and during each of the following 12- 12 month periods, the department shall assign each public school in each district the 13 performance designation of distinguished, successful, deficient, or in crisis based on 14 multiple student measures, including student achievement of essential skills. The state

01 board of education and early development shall establish this process by regulation. 02 * Sec. 3. AS 14.03.123(f) is amended to read: 03 (f) Beginning January 1, 2007 [2005], and periodically during each of the 04 following 12-month periods, the department shall monitor the progress of the 05 implementation of each school improvement plan prepared under (e) of this section. 06 * Sec. 4. Section 3, ch. 58, SLA 1997, as amended by sec. 7, ch. 94, SLA 2001, is amended 07 to read: 08 Sec. 3. Section 1 of this Act takes effect February 1, 2006 [2004]. 09 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 CONDITIONAL EFFECT. This Act takes effect only if the amount of state funding 12 appropriated by law in 2004 for distribution to school districts in the state under AS 14.17.410 13 and for learning opportunity grant funding is less than the amount of state funding 14 appropriated by law for distribution to school districts in the state under AS 14.17.410 and for 15 learning opportunity grant funding in fiscal year 2003. 16 * Sec. 6. If this Act takes effect, it takes effect 30 days after the director of the division of 17 legislative finance notifies the revisor of statutes that the amount of state funding appropriated 18 by law in 2004 for distribution to school districts in the state under AS 14.17.410 and for 19 learning opportunity grant funding is less than the amount of state funding appropriated by 20 law for distribution to school districts in the state under AS 14.17.410 and for learning 21 opportunity grant funding in fiscal year 2003.
