00 HOUSE CS FOR CS FOR SENATE BILL NO. 227(STA) 01 "An Act relating to municipal runoff elections and to municipal initiative and 02 referendum elections." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 29.10.200 is amended by adding a new paragraph to read: 05 (64) AS 29.26.060(e) (runoff election for mayor). 06 * Sec. 2. AS 29.26.060(a) is amended to read: 07 (a) Unless otherwise provided by ordinance, a runoff election shall be held if 08 no candidate receives more than [OVER] 40 percent of the votes cast for the office of 09 [(1) MAYOR; OR 10 (2)] member of the governing body or school board if candidates run 11 for a designated seat. 12 * Sec. 3. AS 29.26.060 is amended by adding new subsections to read: 13 (d) Unless otherwise provided by ordinance, a runoff election shall be held in 14 a municipality with less than 100,000 residents if no candidate receives more than

01 [OVER] 40 percent of the votes cast for the office of mayor. 02 (e) A runoff election shall be held in a municipality with at least 100,000 03 residents if no candidate receives more than [OVER] 50 percent of the votes cast for 04 the office of mayor. 05 (f) Subsection (e) of this section applies to certain home rule and general law 06 municipalities. 07 * Sec. 4. AS 29.26.170(a) is amended to read: 08 (a) Unless substantially the same measure is adopted, when a petition seeks an 09 initiative vote, the clerk shall submit the matter to the voters at the next regular 10 election or, if already scheduled, special election occurring not [NO] sooner than 60 11 [45] days after certification of the petition. If no [REGULAR] election is scheduled 12 to occur [OCCURS] within 75 days after the certification of a petition and the 13 governing body determines it is in the best interest of the municipality, the 14 governing body may by ordinance order [SHALL HOLD] a special election to be 15 held [WITHIN 75 DAYS, BUT NOT SOONER THAN 45 DAYS AFTER 16 CERTIFICATION]. 17 * Sec. 5. AS 29.26.170(b) is amended to read: 18 (b) If the governing body adopts substantially the same measure, the petition 19 is void, and the matter initiated may not be placed before the voters. 20 * Sec. 6. AS 29.26.180(a) is amended to read: 21 (a) Unless the ordinance or resolution is repealed, when a petition seeks a 22 referendum vote, the clerk shall submit the matter to the voters at the next regular 23 election or, if already scheduled, special election occurring not [NO] sooner than 60 24 [45] days after certification of the petition. If no election is scheduled to occur 25 [OCCURS] within 75 days after [OF] certification of a petition and the governing 26 body determines it is in the best interest of the municipality, the governing body 27 may by ordinance order [SHALL HOLD] a special election to be held [WITHIN 75 28 DAYS, BUT NOT SOONER THAN 45 DAYS AFTER CERTIFICATION].
