00 SENATE BILL NO. 138 01 "An Act annulling a regulation relating to use of collaborative practice authority by a 02 pharmacist under written protocols approved by persons licensed to prescribe drugs; 03 prohibiting the Board of Pharmacy from adopting a similar regulation in the future; 04 and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 08.80.030 is amended by adding a new subsection to read: 07 (c) Notwithstanding other provisions of this section or the definition of terms 08 in AS 08.80.480, the board may not adopt a regulation that allows a pharmacist to 09 exercise collaborative practice authority with a person licensed to prescribe drugs 10 under this title under which the pharmacist may initiate or modify drug therapy in 11 accordance with a written protocol approved by the board and the person with 12 prescriptive authority. 13 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 14 read:

01 REGULATION ANNULLED. 12 AAC 52.240, relating to pharmacist collaborative 02 practice authority, is annulled. 03 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 04 read: 05 TRANSITION. A written protocol under 12 AAC 52.240 that is in effect on the day 06 before the effective date of this Act expires on the effective date of this Act. 07 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
