00 CS FOR SENATE BILL NO. 74(RES) am 01 "An Act extending the renewal period for oil discharge prevention and contingency 02 plans; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 *Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 LEGISLATIVE FINDING. The legislature finds that focusing on the actual testing of 07 oil spill prevention and response preparedness through in-the-field inspections, drills, and 08 exercises is our most effective means of ensuring spill prevention and response readiness and 09 protection of the environment. 10 * Sec. 2. AS 46.04.030(d) is amended to read: 11 (d) Upon approval of a contingency plan, the department shall issue to the 12 plan holder a certificate stating that the contingency plan has been approved by the 13 department. The certificate must include the name of the facility, pipeline, tank 14 vessel, or oil barge for which it is issued, the effective date of the contingency plan,

01 and the date by which the contingency plan must be submitted for renewal. A 02 contingency plan must be submitted for renewal every five [THREE] years. 03 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 04 read: 05 TRANSITION. Notwithstanding any contrary provision of AS 46.04, including the 06 review procedures in AS 46.04.030, and the regulations adopted under AS 46.04, the 07 expiration date of an oil discharge prevention and contingency plan approved by the 08 Department of Environmental Conservation before the effective date of this Act shall be 09 extended for two years, or for a shorter period if a shorter period is requested by the holder of 10 the approved plan, if 11 (1) the plan is still in effect on the day before the effective date of this Act; 12 and 13 (2) the Department of Environmental Conservation has not given a notice of 14 violation of AS 46.04.030 to the holder of the plan that has not been corrected to the 15 satisfaction of the Department of Environmental Conservation. 16 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
