00 CS FOR SENATE BILL NO. 74(RES) 01 "An Act extending the renewal period for oil discharge prevention and contingency 02 plans; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 46.04.030(d) is amended to read: 05 (d) Upon approval of a contingency plan, the department shall issue to the 06 plan holder a certificate stating that the contingency plan has been approved by the 07 department. The certificate must include the name of the facility, pipeline, tank 08 vessel, or oil barge for which it is issued, the effective date of the contingency plan, 09 and the date by which the contingency plan must be submitted for renewal. A 10 contingency plan must be submitted for renewal every five [THREE] years. 11 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 12 read: 13 TRANSITION. Notwithstanding any contrary provision of AS 46.04, including the 14 review procedures in AS 46.04.030, and the regulations adopted under AS 46.04, the

01 expiration date of an oil discharge prevention and contingency plan approved by the 02 Department of Environmental Conservation before the effective date of this Act shall be 03 extended for two years, or for a shorter period if a shorter period is requested by the holder of 04 the approved plan, if 05 (1) the plan is still in effect on the day before the effective date of this Act; 06 and 07 (2) the Department of Environmental Conservation has not given a notice of 08 violation of AS 46.04.030 to the holder of the plan that has not been corrected to the 09 satisfaction of the Department of Environmental Conservation. 10 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
