00 HOUSE BILL NO. 555 01 "An Act relating to occupational licensing fees and receipts." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 08.01.065(c) is amended to read: 04 (c) The [EXCEPT AS PROVIDED IN (f) - (i) OF THIS SECTION, THE] 05 department shall establish fee levels under (a) of this section so that the total amount 06 of fees, together with the fines and penalties collected for all occupations 07 regulated by a board [AN OCCUPATION] approximately equals the total actual 08 [REGULATORY] costs of the board and the department for all occupations 09 regulated by that board. If the department regulates more than one occupation 10 under another chapter of this title, the department shall establish the fee levels so 11 that the total amount of fees, together with the fines and penalties collected by the 12 department for all occupations regulated by the department under that chapter, 13 approximately equals the total actual costs of the department for all of the 14 occupations regulated by the department under that chapter [FOR THE 15 OCCUPATION]. The department shall annually review each fee level to determine
01 whether the [REGULATORY] costs of each occupation are approximately equal to 02 fee collections related to that occupation. If the review indicates that an occupation's 03 fee collections and [REGULATORY] costs are not approximately equal, the 04 department shall calculate fee adjustments and adopt regulations under (a) of this 05 section to implement the adjustments. In January of each year, the department shall 06 report on all fee levels and revisions for the previous year under this subsection to the 07 office of management and budget. If a board regulates an occupation covered by this 08 chapter, the department shall consider the board's recommendations concerning the 09 occupation's fee levels and [REGULATORY] costs before revising fee schedules to 10 comply with this subsection. [IN THIS SUBSECTION, "REGULATORY COSTS" 11 MEANS COSTS OF THE DEPARTMENT THAT ARE ATTRIBUTABLE TO 12 REGULATION OF AN OCCUPATION PLUS 13 (1) ALL EXPENSES OF THE BOARD THAT REGULATES THE 14 OCCUPATION IF THE BOARD REGULATES ONLY ONE OCCUPATION; 15 (2) THE EXPENSES OF A BOARD THAT ARE ATTRIBUTABLE 16 TO THE OCCUPATION IF THE BOARD REGULATES MORE THAN ONE 17 OCCUPATION.] 18 * Sec. 2. AS 08.01.065(f) is amended to read: 19 (f) [NOTWITHSTANDING (c) OF THIS SECTION, THE DEPARTMENT 20 SHALL ESTABLISH FEE LEVELS UNDER (a) OF THIS SECTION SO THAT 21 THE TOTAL AMOUNT OF FEES COLLECTED BY THE STATE BOARD OF 22 REGISTRATION FOR ARCHITECTS, ENGINEERS, AND LAND SURVEYORS 23 APPROXIMATELY EQUALS THE TOTAL REGULATORY COSTS OF THE 24 DEPARTMENT AND THE BOARD FOR ALL OCCUPATIONS REGULATED BY 25 THE BOARD.] The department shall set [THE] fee levels under (a) of this section 26 [FOR THE ISSUANCE AND RENEWAL OF A CERTIFICATE OF 27 REGISTRATION ISSUED UNDER AS 08.48.211] so that the fee levels are the same 28 for all occupations regulated by the State Board of Registration for Architects, 29 Engineers, and Land Surveyors under AS 08.48 [BOARD]. 30 * Sec. 3. AS 08.01.065(g) is amended to read: 31 (g) [NOTWITHSTANDING (c) OF THIS SECTION, THE DEPARTMENT
01 SHALL ESTABLISH FEE LEVELS UNDER (a) OF THIS SECTION SO THAT 02 THE TOTAL AMOUNT OF FEES COLLECTED BY THE DEPARTMENT FOR 03 ALL OCCUPATIONS REGULATED UNDER AS 08.11 APPROXIMATELY 04 EQUALS THE TOTAL REGULATORY COSTS OF THE DEPARTMENT FOR 05 ALL OCCUPATIONS REGULATED BY THE DEPARTMENT UNDER AS 08.11.] 06 The department shall set [THE] fee levels under (a) of this section [FOR THE 07 ISSUANCE AND RENEWAL OF LICENSES ISSUED UNDER AS 08.11] so that 08 the fee levels are the same for all occupations regulated by the department under 09 AS 08.11. 10 * Sec. 4. AS 08.01.065(i) is amended to read: 11 (i) [NOTWITHSTANDING (c) OF THIS SECTION, THE DEPARTMENT 12 SHALL ESTABLISH FEE LEVELS UNDER (a) OF THIS SECTION SO THAT 13 THE TOTAL AMOUNT OF FEES COLLECTED BY THE DEPARTMENT OF 14 COMMUNITY AND ECONOMIC DEVELOPMENT FOR SPECIALTY 15 CONTRACTORS, HOME INSPECTORS, AND ASSOCIATE HOME 16 INSPECTORS APPROXIMATELY EQUALS THE TOTAL REGULATORY 17 COSTS OF THE DEPARTMENT FOR THOSE THREE REGISTRATION 18 CATEGORIES.] The department shall set [THE] fee levels under (a) of this section 19 [FOR THE ISSUANCE AND RENEWAL OF A CERTIFICATE OF 20 REGISTRATION ISSUED UNDER AS 08.18] so that the fee levels are the same for 21 specialty contractors, home inspectors, and associate home inspectors under 22 AS 08.18 [ALL THREE OF THESE REGISTRATION CATEGORIES] and so that 23 the fee level for a home inspector with a joint registration is not different from the fee 24 level for a home inspector who does not have a joint registration. In this subsection, 25 "joint registration" has the meaning given in AS 08.18.171. 26 * Sec. 5. AS 37.05.146(c)(24) is amended to read: 27 (24) receipts of the Department of Community and Economic 28 Development under AS 08.01.065 and from fines and penalties collected in 29 licensing and disciplinary actions for occupations under AS 08.01.010 30 [AS 08.01.065(a), (c), AND (f)]; 31 * Sec. 6. AS 08.95.920 is repealed.
