01 "An Act relating to a charge for a bad check."                                                                          
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 09.68.115(a) is amended to read:                                                                  
04            (a)  In an action against a person who issues a check that is dishonored, the                                
05       plaintiff may recover damages in an amount equal to $100 or triple the amount of the                              
06       check, whichever is greater, except that damages recovered under this section may not                             
07       exceed the amount of the check by more than $1,000 and may be awarded only if                                     
08                 (1)  the plaintiff makes a written demand for payment of the check at                                   
09       least 15 days before commencing [BEGINNING] the action; and                                                   
10                 (2)  the defendant fails to tender, before the action commences                                     
11       [BEGINS], an amount equal to [AT LEAST] the amount of the check plus a $30 fee,                               
12       but [COSTS INCURRED BY] the plaintiff may waive collection [UP TO A                                       
13       MAXIMUM] of any fee [$25].
