01 "An Act relating to the issuance of commercial fishing interim-use permits; and                                         
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 16.43.210(a) is amended to read:                                                                  
05            (a)  For each fishery that is not subject to a [PENDING THE                                              
06       ESTABLISHMENT OF THE] maximum number of entry permits under                                                       
07       AS 16.43.240 and not subject to a moratorium under AS 16.43.225 [THE                                          
08       ISSUANCE OF ENTRY PERMITS UNDER AS 16.43.270], the commission shall                                               
09       issue interim-use permits under regulations adopted by the commission [FOR EACH                                   
10       FISHERY, NOT SUBJECT TO A MORATORIUM UNDER AS 16.43.225,] to all                                                  
11       applicants who can establish their present ability to participate actively in the fishery                         
12       for which they are making application.                                                                            
13    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
14 read:                                                                                                                   

01       RETROACTIVITY.  Section 1 of this Act is retroactive to April 27, 1973.                                           
02    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
