00 HOUSE BILL NO. 448 01 "An Act relating to amending reporting requirements for contributions to groups; to 02 limitations on the amount of political contributions by individuals and groups; 03 amending the definition of the term 'lobbyist' in the Regulation of Lobbying Act; 04 amending the requirement for the reporting of financial interests by certain public 05 officials in the legislative branch; and providing for an effective date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 15.13.040(b) is amended to read: 08 (b) Each [EXCEPT AS PROVIDED IN (l) OF THIS SECTION, EACH ] 09 group shall make a full report upon a form prescribed by the commission, listing 10 (1) the name and address of each officer and director; 11 (2) the aggregate amount of all contributions made to it; 12 (3) for all contributions in excess of $100 in the aggregate during a 13 calendar year, the name, address, principal occupation, and employer of the

01 contributor, and the date [,] and amount contributed by each contributor [AND, FOR 02 CONTRIBUTIONS IN EXCESS OF $250 IN THE AGGREGATE DURING A 03 CALENDAR YEAR, THE PRINCIPAL OCCUPATION AND EMPLOYER OF THE 04 CONTRIBUTOR]; and 05 (4) the date and amount of all contributions made by it and all 06 expenditures made, incurred, or authorized by it. 07 * Sec. 2. AS 15.13.070(b) is amended to read: 08 (b) An individual may contribute not more than 09 (1) $500 a [$1,000 PER] year to a nongroup entity for the purpose of 10 influencing the nomination or election of a candidate, to a candidate, to an individual 11 who conducts a write-in campaign as a candidate, or to a group that is not a political 12 party; 13 (2) $5,000 a [$10,000 PER] year to a political party [FOR THE 14 PURPOSE OF INFLUENCING THE NOMINATION OR ELECTION OF A 15 CANDIDATE OR CANDIDATES]. 16 * Sec. 3. AS 15.13.070(c) is amended to read: 17 (c) A group that is not a political party may contribute not more than $1,000 a 18 year 19 (1) [$2,000 PER YEAR] to a candidate, or to an individual who 20 conducts a write-in campaign as a candidate; 21 (2) [$2,000 PER YEAR] to another group, to [OR] a nongroup entity, 22 [;] or 23 [(3) $4,000 PER YEAR] to a political party. 24 * Sec. 4. AS 24.45.171(8) is amended to read: 25 (8) "lobbyist" means a person who 26 (A) is employed and receives payments, or who contracts 27 for economic consideration, including reimbursement for reasonable 28 travel and living expenses, to communicate directly or through the 29 person's agents with any public official for the purpose of influencing 30 legislative or administrative action for more than 10 hours in any 30-day 31 period in one calendar year; or

01 (B) represents the person as engaging [ENGAGES] in the 02 influencing of legislative or administrative action as a business, occupation, 03 or profession [OF INFLUENCING LEGISLATIVE OR ADMINISTRATIVE 04 ACTION; OR 05 (B) RECEIVES WAGES OR OTHER ECONOMIC 06 CONSIDERATION, INCLUDING REIMBURSEMENT OF TRAVEL AND 07 LIVING EXPENSES, TO COMMUNICATE DIRECTLY WITH ANY 08 PUBLIC OFFICIAL 09 (i) FOR THE EXPRESS PURPOSE OF 10 INFLUENCING LEGISLATIVE OR ADMINISTRATIVE ACTION; 11 AND 12 (ii) DURING MORE THAN 40 HOURS IN ANY 30- 13 DAY PERIOD IN ONE CALENDAR YEAR]; 14 * Sec. 5. AS 24.60.200(a) is amended to read: 15 (a) A legislator, a public member of the committee, and a legislative director 16 shall file a disclosure statement, under oath and on penalty of perjury, with the Alaska 17 Public Offices Commission giving the following information about the income 18 received by the discloser, the discloser's spouse or domestic partner, the discloser's 19 dependent children, and the discloser's nondependent children who are living with the 20 discloser: 21 (1) the information that a public official is required to report under 22 AS 39.50.030, other than information about gifts; 23 (2) as to income in excess of $1,000 [$5,000] received as 24 compensation for personal services, the name and address of the source of the income, 25 and a statement describing the nature of the services performed; if the source of 26 income is known or reasonably should be known to have a substantial interest in 27 legislative, administrative, or political action and the recipient of the income is a 28 legislator or a legislative director, the amount of income received from the source shall 29 be disclosed; 30 (3) as to each loan or loan guarantee over $1,000 from a source with a 31 substantial interest in legislative, administrative, or political action, the name and

01 address of the person making the loan or guarantee, the amount of the loan, the terms 02 and conditions under which the loan or guarantee was given, the amount outstanding 03 at the time of filing, and whether or not a written loan agreement exists. 04 * Sec. 6. This Act takes effect January 1, 2005.
