00 HOUSE BILL NO. 318 01 "An Act relating to missions and measures to be applied to certain expenditures by the 02 executive branch of state government and the University of Alaska and by the judicial 03 branch of state government from the state operating budget for the fiscal year ending 04 June 30, 2004; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. Addition to the uncodified law of the state. The uncodified law of the State 07 of Alaska is amended by adding the new sections set out in secs. 1 - 148 of this Act. 08 * Sec. 2. Legislative purpose and preamble. (a) The purpose of this Act is to state the 09 missions, when expending money appropriated by the operating budget for the fiscal year 10 2004, for the departments of state government and for those divisions within departments that 11 the legislature reviewed in 2003 and, in some cases, to set out performance measures for 12 divisions or programs within divisions. 13 (b) All departments of state government shall be held accountable for their actions, 14 including compliance with the recommendations of legislative audits as directed by the

01 legislature. 02 Article 1. Department of Administration. 03 * Sec. 3. Department of Administration. The mission of the Department of 04 Administration is to provide 05 (1) centralized management and technology services to state agencies; 06 (2) reasonable but not excessive legal and advocacy services for indigent 07 Alaskans; 08 (3) programs that promote the independence of Alaska's seniors; 09 (4) vehicle licensing and registration. 10 * Sec. 4. Admin - Office of the Commissioner. (a) The mission of the Office of the 11 Commissioner is to provide support and policy direction to divisions within the department. 12 (b) The legislature intends to measure the success of the office in achieving its 13 mission by considering the 14 (1) percentage of divisions within the department that require an unanticipated 15 supplemental budget increase; 16 (2) average time taken to respond to complaints and questions that have been 17 elevated to the commissioner's office; 18 (3) number of work initiatives implemented that resulted in more efficient 19 ways to perform the department's mission compared to the prior year; 20 (4) innovative ways the department uses to improve the state's compliance 21 with the merit system requirement while reducing costs. 22 * Sec. 5. Admin - Office of Tax Appeals. (a) The mission of the Office of Tax Appeals is 23 to offer independent adjudication for tax and administrative appeals. 24 (b) The legislature intends to measure the success of the office in achieving its 25 mission by considering the 26 (1) percentage of change when compared to the prior fiscal year in the average 27 cost for each appeal; 28 (2) percentage of change in the average time for each appeal when compared 29 to the prior fiscal year and for each type of appeal; 30 (3) percentage of participants in appeals who, when surveyed, believed they 31 were treated fairly.

01 * Sec. 6. Admin - Division of Administrative Services. (a) The mission of the Division 02 of Administrative Services is to provide support services to departmental programs. 03 (b) The legislature intends to measure the success of the division in achieving its 04 mission by considering the 05 (1) percentage of change when compared to the prior fiscal year of costs for 06 administrative services; 07 (2) percentage of change when compared to the prior fiscal year in the number 08 of departmental employee grievances compared to all state department grievances; 09 (3) percentage of change when compared to the prior fiscal year in the number 10 of late vendor payments compared to the total number of vendor payments; 11 (4) average response time for desktop support; 12 (5) average time to complete the work requested from desktop support; 13 (6) percent of late reimbursement payments made to employees. 14 * Sec. 7. Admin - Division of Finance. (a) The mission of the Division of Finance is to 15 provide accounting and payroll services for state government. 16 (b) The legislature intends to measure the success of the division in achieving its 17 mission by considering the change in the 18 (1) amount and percentages of penalty pay for the state's central payroll; 19 (2) number of audit exceptions; 20 (3) down time for the Alaska Statewide Accounting System and the Alaska 21 Statewide Payroll System. 22 * Sec. 8. Admin - Division of Personnel. (a) The mission of the Division of Personnel is 23 to assist state agencies to hire and retain a qualified workforce. 24 (b) The legislature intends to measure the success of the division in achieving its 25 mission by considering the 26 (1) percentage of change when compared to the prior fiscal year in the 27 grievance arbitrations won; 28 (2) number of employment discrimination complaints from state employees 29 received by the State Commission for Human Rights as a percentage of the total number of 30 state employees and the percentage of complaints of employment discrimination filed with the 31 commission that allege discrimination by the state;

01 (3) percentage of change when compared to the prior fiscal year in the down 02 time in the availability of Workplace Alaska; 03 (4) percentage of change in the length of time taken to settle disputed 04 classification actions compared to the time required in previous years; 05 (5) number of workers given merit increases for truly meritorious performance 06 compared to the number of workers denied merit increases. 07 * Sec. 9. Admin - Division of General Services. (a) The mission of the Division of 08 General Services is to provide centralized support services. 09 (b) The legislature intends to measure the success of the division in achieving its 10 mission by considering the 11 (1) percentage of change when compared to the prior fiscal year in the number 12 of violations of procurement codes; 13 (2) cost per square foot of leased space; 14 (3) money saved through the use of master contracts; 15 (4) length of time taken to procure leased space. 16 * Sec. 10. Admin - Division of Retirement and Benefits. (a) The mission of the Division 17 of Retirement and Benefits is to assure access to benefits for public employees and retirees. 18 (b) The legislature intends to measure the success of the division in achieving its 19 mission by considering the 20 (1) length of time taken to process appointments to retirement; 21 (2) number of health insurance reimbursement complaints; 22 (3) average length of time taken to process health care claims. 23 * Sec. 11. Admin - Information Technology Group. (a) The mission of the Information 24 Technology Group is to provide technology support for data processing and 25 telecommunications infrastructure. 26 (b) The legislature intends to measure the success of the Information Technology 27 Group in achieving its mission by considering 28 (1) down time for the mainframe computer; 29 (2) down time for telecommunications systems; 30 (3) percentage of change when compared to the prior fiscal year in the number 31 of on-line services.

01 * Sec. 12. Admin - Division of Public Communications Services. (a) The mission of the 02 Division of Public Communications Services is to ensure infrastructure for the dissemination 03 of information statewide. 04 (b) The legislature intends to measure the success of the division in achieving its 05 mission by considering the number of communities 06 (1) without public radio service; 07 (2) without public television service; 08 (3) served by public radio with access to commercial radio; 09 (4) served by public television with access to commercial television. 10 * Sec. 13. Admin - Division of Risk Management. (a) The mission of the Division of 11 Risk Management is to manage the state's financial exposure due to loss. 12 (b) The legislature intends to measure the success of the division in achieving its 13 mission by considering the 14 (1) average cost of workers' compensation claims; 15 (2) number of recurring claims; 16 (3) amount paid for insurance compared to the value of property covered. 17 * Sec. 14. Admin - Oil and Gas Conservation Commission. (a) The mission of the Oil 18 and Gas Conservation Commission is to protect the public interest in oil and gas resources. 19 (b) The legislature intends to measure the success of the commission in achieving its 20 mission by considering the 21 (1) average time the commission takes to process permits; 22 (2) percentage of change when compared to the prior fiscal year in the number 23 of well site inspections; 24 (3) percentage of change when compared to the prior fiscal year in the number 25 of independent reservoir evaluations. 26 * Sec. 15. Admin - Office of Public Advocacy. (a) The mission of the Office of Public 27 Advocacy is to provide legal representation to and serve as guardians for vulnerable Alaskans. 28 (b) The legislature intends to measure the success of the office in achieving its 29 mission by considering the number of 30 (1) children provided permanent placement; 31 (2) cases successfully completed within the Alaska Court System time

01 standards; 02 (3) pleadings for which extensions are requested as compared to the total 03 number filed. 04 * Sec. 16. Admin - Public Defender Agency. (a) The mission of the Public Defender 05 Agency is to provide constitutionally mandated legal representation to indigent clients. 06 (b) The legislature intends to measure the success of the agency in achieving its 07 mission by considering the number of 08 (1) defense cases successfully completed within the Alaska Court System time 09 standards; 10 (2) pleadings for which extensions are requested as compared to the total 11 number filed; 12 (3) requests for continuance of hearings or trials filed by the agency; 13 (4) wins and losses of appeals compared with the private sector. 14 * Sec. 17. Admin - Division of Motor Vehicles. (a) The mission of the Division of Motor 15 Vehicles is to ensure driver qualification and to record vehicle ownership. 16 (b) The legislature intends to measure the success of the division in achieving its 17 mission by considering 18 (1) when compared to the prior fiscal year, the percentage of change in the 19 number of complaints compared to the number of transactions by location; 20 (2) the average waiting time before a person receives service; 21 (3) the number of suspensions of drivers' licenses as compared to the number 22 of crash participants; 23 (4) the average cost of each transaction; 24 (5) the percentage of transactions by private partners. 25 Article 2. Department of Community and Economic Development. 26 * Sec. 18. Department of Community and Economic Development. The mission of the 27 Department of Community and Economic Development is to promote independent 28 sustainable communities and economic development in Alaska. 29 * Sec. 19. DCED - Office of the Commissioner. (a) The mission of the Office of the 30 Commissioner is to provide management support and policy direction to divisions within the 31 department.

01 (b) The legislature intends to measure the success of the office in achieving its 02 mission by considering, as compared to each of the previous five years, the number of 03 divisions that 04 (1) meet assigned performance measures; 05 (2) require a general fund supplemental budget increase. 06 * Sec. 20. DCED - Division of Administrative Services. (a) The mission of the Division 07 of Administrative Services is to provide support services to departmental programs. 08 (b) The legislature intends to measure the success of the division in achieving its 09 mission by considering, as compared to each of the previous five years, the 10 (1) percentage of late vendor payments; 11 (2) number of audit exceptions; 12 (3) percentage of procurement protests that have been upheld; 13 (4) number and percentage of employee grievances advanced to and sustained 14 in arbitration. 15 * Sec. 21. DCED - Division of Community Advocacy. (a) The mission of the Division 16 of Community Advocacy is to promote independent local governments and job growth. 17 (b) The legislature intends to measure the success of the division in achieving its 18 mission by considering, as compared to each of the previous five years, 19 (1) the number of CDQ-related (community development quota related) jobs 20 in Alaska; 21 (2) the number of local governments formed; 22 (3) the number of local governments dissolved; 23 (4) the number of unorganized communities in the state by region; 24 (5) how much, expressed as a percentage, local governments rely on revenue 25 sharing in their general operating budgets. 26 (c) The mission of the Alaska Regional Development Organization (ARDOR) 27 program is to encourage a healthier economic climate in Alaska by increasing the number of 28 jobs, strengthening existing businesses, attracting new businesses, and encouraging economic 29 diversification. 30 (d) The legislature intends to measure the success of the ARDOR program in 31 achieving its mission by considering the

01 (1) number of coordinated regional efforts resulting in creation of new 02 business opportunities; 03 (2) percentage of goals identified through regional processes that are achieved; 04 (3) change in the amount of nonstate funds leveraged by ARDOR grants. 05 * Sec. 22. DCED - Division of Trade and Development. (a) The mission of the Division 06 of Trade and Development is to promote economic development and increase the amount of 07 international trade and investment in Alaska. 08 (b) The legislature intends to measure the success of the division in achieving its 09 mission by considering, as compared to the previous five years, the 10 (1) number and percentage of Alaskans employed within the state; 11 (2) number of Alaska firms that export services and products; 12 (3) number of Alaska firms that import services and products; 13 (4) dollar value of exports from the state; 14 (5) dollar value of imports to the state. 15 * Sec. 23. DCED - Division of Investments. (a) The mission of the Division of 16 Investments is to 17 (1) promote economic development through direct state lending within those 18 industries that are not adequately served by the private sector; 19 (2) provide interagency and interdepartmental loan servicing of other loan 20 portfolios. 21 (b) The legislature intends to measure the success of the division in achieving its 22 mission by considering 23 (1) the number of new or retained jobs in the state per loan made from the 24 Small Business Economic Development Revolving Loan Fund; 25 (2) whether the division maintains the proportion of commercial fishing 26 permits held by Alaskans at 75 percent or higher through the Commercial Fishing Revolving 27 Loan Fund; 28 (3) whether the division provides hatchery-reared salmon to Alaska 29 commercial fisheries at a harvest value of $40,000,000 or more per year through the Fisheries 30 Enhancement Revolving Loan Fund. 31 * Sec. 24. DCED - Alaska Aerospace Development Corporation. (a) The mission of the

01 Alaska Aerospace Development Corporation is to promote aerospace-related economic 02 growth and to develop corresponding technologies and support services. 03 (b) The legislature intends to measure the success of the corporation in achieving its 04 mission by considering, as compared to each of the previous five years, the 05 (1) number of launches per year; 06 (2) earnings per launch; 07 (3) number of permanent private sector jobs created; 08 (4) number of new space-related projects brought to the state. 09 * Sec. 25. DCED - Alaska Industrial Development and Export Authority. (a) The 10 mission of the Alaska Industrial Development and Export Authority is to foster statewide 11 industrial development and diversification. 12 (b) The legislature intends to measure the success of the authority in achieving its 13 mission by considering, as compared to each of the previous five years, the 14 (1) number of permanent jobs created; 15 (2) loan delinquency rate; 16 (3) amount and percentage of earnings of the authority available to the state as 17 a dividend. 18 * Sec. 26. DCED - Alaska Energy Authority. (a) The mission of the Alaska Energy 19 Authority is to foster utilization of Alaska's natural resources and new technology to achieve 20 the lowest reasonable consumer power costs. 21 (b) The legislature intends to measure the success of the authority in achieving its 22 mission by considering, as compared to the previous five years, the 23 (1) average cost of electricity by region; 24 (2) projects that utilize new technology to generate and deliver electricity. 25 * Sec. 27. DCED - Rural Energy Programs. (a) The mission of rural energy programs is 26 to lower the cost and increase the reliability of rural energy systems. 27 (b) The legislature intends to measure the success of the rural energy programs by 28 considering, as compared to the previous five years, the 29 (1) average power cost for households receiving power cost equalization 30 compared to average statewide costs; 31 (2) reliability of rural energy systems;

01 (3) number and percentage of communities that are self-reliant in fully 02 maintaining their power systems. 03 * Sec. 28. DCED - Alaska Seafood Marketing Institute. (a) The mission of the Alaska 04 Seafood Marketing Institute (ASMI) is to 05 (1) increase worldwide consumption of Alaska seafood; 06 (2) promote the quality and superiority of Alaska seafood products; and 07 (3) accomplish these marketing efforts while maximizing ASMI staff who are 08 residents and under ASMI employment in Alaska. 09 (b) The legislature intends to measure the success of the institute in achieving its 10 mission by considering, as compared to the previous five years, the 11 (1) change in the number of markets where Alaska seafood is sold; 12 (2) amount of seafood sold; 13 (3) percentage of ASMI staff that resides in Alaska and average salaries of 14 Alaska staff compared to out-of-state staff. 15 * Sec. 29. DCED - Division of Banking, Securities, and Corporations. (a) The mission 16 of the Division of Banking, Securities, and Corporations is to 17 (1) maintain a stable financial network in the state for the safe conduct of 18 financial services; 19 (2) protect securities investors from market fraud; 20 (3) provide businesses with a legal structure enabling commerce in the state. 21 (b) The legislature intends to measure the success of the division in achieving its 22 mission by considering, as compared to the previous five years, the 23 (1) amount and percentage of uncollected fines that have not been converted 24 to court judgment; 25 (2) average time taken to respond to and resolve complaints. 26 * Sec. 30. DCED - Division of Insurance. (a) The mission of the Division of Insurance is 27 to 28 (1) develop regulations and uphold and enforce insurance statutes; 29 (2) protect and educate the consumer; 30 (3) enhance the insurance business environment. 31 (b) The legislature intends to measure the success of the division in achieving its

01 mission by considering, as compared to the previous five years, the 02 (1) average time taken to respond to complaints; 03 (2) average number of days required to process applications and issue licenses 04 and renewals; 05 (3) number and percentage of insurance-related civil and criminal complaints 06 upheld. 07 * Sec. 31. DCED - Division of Occupational Licensing. (a) The mission of the Division 08 of Occupational Licensing is to ensure that competent professional and commercial services 09 are available to Alaska consumers. 10 (b) The legislature intends to measure the success of the division in achieving its 11 mission by considering, as compared to the previous five years, the 12 (1) average time taken to respond from the filing of a licensing law complaint 13 to the conclusion of the case; 14 (2) number and timing of the various license testing opportunities when the 15 department controls the scheduling of the tests; 16 (3) number of violations of licensing laws; 17 (4) number of license revocations resulting from violations of licensing law. 18 * Sec. 32. DCED - Regulatory Commission of Alaska. (a) The mission of the 19 Regulatory Commission of Alaska is to regulate public utilities and pipelines in Alaska. 20 (b) The legislature intends to measure the success of the commission in achieving its 21 mission by considering the 22 (1) time required to issue public notice, provide an initial analysis, and render 23 the initial commission determination concerning 24 (A) utility and pipeline filings; 25 (B) competitive offerings; 26 (2) percentage of the change when compared to the prior fiscal year in the 27 number of unresolved filings. 28 Article 3. Department of Corrections. 29 * Sec. 33. Department of Corrections. The mission of the Department of Corrections is 30 to protect the public by incarcerating and supervising offenders. 31 * Sec. 34. DCorrections - Office of the Commissioner. (a) The mission of the Office of

01 the Commissioner is to provide support in meeting the mission of the department. 02 (b) The legislature intends to measure the success of the office in achieving its 03 mission by considering the 04 (1) percentage of divisions that meet assigned performance measures; 05 (2) number of convicted inmates released in a calendar year who return to 06 incarceration after being convicted of a new offense within one year, two years, and three 07 years after the release; 08 (3) number of bookings in institutions; 09 (4) annual average number of offenders in institutions and on felony 10 supervision; 11 (5) total number of prisoner transports; 12 (6) average time taken to respond to complaints and questions that have been 13 elevated to the commissioner's office; 14 (7) compliance with statutory requirements for facilities, including the Alaska 15 No Frills Prison Act. 16 * Sec. 35. DCorrections - Division of Administrative Services. (a) The mission of the 17 Division of Administrative Services is to provide support services to assist the department in 18 meeting its mission. 19 (b) The legislature intends to measure the success of the division in achieving its 20 mission by considering the 21 (1) cost of the division compared to personnel costs for the department; 22 (2) number of late penalties incurred for payroll divided by the number of 23 paychecks issued; 24 (3) number of late penalties incurred for vendor payments divided by the 25 number of vendor payments issued; 26 (4) number of complaints received concerning payroll errors divided by the 27 number of pay checks issued; 28 (5) number of outstanding audit exceptions divided by the audits during the 29 fiscal year. 30 * Sec. 36. DCorrections - Division of Institutions, Inmate Health Care. (a) The 31 mission of inmate health care is to provide statutorily required health care for offenders under

01 the custody of the department. 02 (b) The legislature intends to measure the success of the inmate health care section in 03 achieving its mission by considering the 04 (1) average medical cost per inmate; 05 (2) amount of inmate co-pay fees collected annually; 06 (3) amount of fees collected from third-party billings. 07 * Sec. 37. DCorrections - Division of Institutions, Inmate Programs. (a) The mission 08 of inmate programs is to provide opportunities for positive change and to rehabilitate inmates. 09 (b) The legislature intends to measure the success of the inmate programs section in 10 achieving its mission by considering the number of 11 (1) inmates who complete programs successfully divided by the number of 12 inmates enrolled in the program, set out by program; 13 (2) re-admits who completed inmate programs during previous incarcerations 14 with the department set out by program; 15 (3) inmates who have completed GED programs when compared to the 16 number enrolled. 17 * Sec. 38. DCorrections - Alaska Correctional Industries. (a) The mission of the 18 Alaska Correctional Industries (ACI) is to assist in the rehabilitation of inmates by providing 19 marketable work skills. 20 (b) The legislature intends to measure the success of the Alaska Correctional 21 Industries in achieving its mission by considering 22 (1) income divided by expense for each ACI program; 23 (2) the percentage of ACI participants, set out by program, with sentences of 24 (A) less than three years; 25 (B) three years to less than seven years; 26 (C) seven years to less than 12 years; 27 (D) 12 or more years; 28 (3) the percentage of inmate pay that is used to pay court-ordered obligations; 29 (4) the percentage of sentenced inmates who participate in Alaska 30 Correctional Industries. 31 * Sec. 39. DCorrections - Division of Institutions. (a) The mission of the Division of

01 Institutions is to protect the public by incarcerating offenders. 02 (b) The legislature intends to measure the success of the division in achieving its 03 mission by considering the change in the 04 (1) number of inmates assaulted by staff while in custody; 05 (2) number of inmates assaulted by other inmates while in custody; 06 (3) number of inmate suicides and reportable suicide attempts; 07 (4) average cost per day per inmate for the last 10 years. 08 * Sec. 40. DCorrections - Division of Probation and Parole. (a) The mission of the 09 Division of Probation and Parole is to protect the public by supervising offenders. 10 (b) The legislature intends to measure the success of the division in achieving 11 its mission by considering the 12 (1) total number of field and office contacts made by officers; 13 (2) number of offenders on felony supervision divided by the number 14 of felony offences committed by offenders on felony supervision; 15 (3) number of offenders on felony supervision divided by the number 16 of misdemeanor offences committed by offenders on felony supervision. 17 * Sec. 41. DCorrections - Division of Institutions, Electronic Monitoring. (a) The 18 mission of electronic monitoring is to monitor offenders in the community. 19 (b) The legislature intends to measure the success of the electronic monitoring section 20 in achieving its mission by considering the 21 (1) total cost of the program per man-day; 22 (2) number of participants failing the program divided by the total number of 23 participants set out by geographic location. 24 * Sec. 42. DCorrections - Parole Board. (a) The mission of the Parole Board is to 25 administer the release of eligible correctional inmates while providing for public safety and 26 for the successful integration of parolees into the community. 27 (b) The legislature intends to measure the success of the board in achieving its 28 mission by considering the change in the number of discretionary parolees who are arrested 29 and returned to the custody of the Department of Corrections each year. 30 Article 4. Department of Education and Early Development. 31 * Sec. 43. Department of Education and Early Development. The mission of the

01 Department of Education and Early Development is to support the development of lifelong 02 learners. 03 * Sec. 44. DOEED - Office of the Commissioner. (a) The mission of the Office of the 04 Commissioner is to provide support and policy direction to the divisions within the 05 department. 06 (b) The legislature intends to measure the success of the office in achieving its 07 mission by considering the percentage of 08 (1) students who meet the proficiency level in benchmark assessments in 09 grades 3, 6, and 8 reported for all students 10 (A) on a statewide basis; 11 (B) in major racial and ethnic groups; 12 (C) with disabilities; 13 (D) with limited English proficiency; 14 (E) who are economically disadvantaged; 15 (2) students performing above the national average on state-adopted norm- 16 referenced tests for all students 17 (A) on a statewide basis; 18 (B) in major racial and ethnic groups; 19 (C) with disabilities; 20 (D) with limited English proficiency; 21 (E) who are economically disadvantaged; 22 (3) students who took and passed the state high school graduation qualifying 23 exam in the current school year for all students 24 (A) on a statewide basis; 25 (B) in major racial and ethnic groups; 26 (C) with disabilities; 27 (D) with limited English proficiency; 28 (E) who are economically disadvantaged; 29 (4) students in a high school cohort group (graduating class) who pass the 30 state high school graduation qualifying exam on a cumulative basis; 31 (5) school districts meeting the minimum expenditures for instruction.

01 * Sec. 45. DOEED - Division of Teaching and Learning Support. (a) The mission of 02 the Division of Teaching and Learning Support is to improve student performance. 03 (b) The legislature intends to measure the success of the division in achieving its 04 mission by considering the 05 (1) number and percentage of schools that demonstrated Adequate Yearly 06 Progress (AYP), as defined in the Statewide Comprehensive Accountability Plan; 07 (2) percentage change in the number of eligible children served in a Head 08 Start program; 09 (3) percentage change in the number of children who receive federally funded 10 meals. 11 * Sec. 46. DOEED - Division of Early Development. (a) The mission of the Division of 12 Early Development is to provide early child care and education programs. 13 (b) The legislature intends to measure the success of the division by considering the 14 (1) percentage change in the number of children served in licensed and in 15 registered child care facilities; 16 (2) percentage change in the number of eligible children served in a Head 17 Start program; 18 (3) percentage change in the number of staff in child care facilities who 19 received at least 15 hours of training in the current fiscal year; 20 (4) percentage change in the number of children who receive federally funded 21 meals; 22 (5) change in the ratio of registered providers compared to licensed providers. 23 * Sec. 47. DOEED - Division of Education Support Services. The mission of the 24 Division of Education Support Services is to provide support services to departmental 25 programs and the operation of public schools. 26 * Sec. 48. DOEED - Professional Teaching Practices Commission/Alaska State 27 Council on the Arts. (a) The mission of the Professional Teaching Practices Commission is 28 to ensure that members of the teaching profession in the state are qualified and ethical 29 educators. 30 (b) The legislature intends to measure the success of the commission in achieving its 31 mission by considering the annual costs

01 (1) and number of administrative actions on a year-to-year basis for 02 (A) contested hearings; 03 (B) uncontested hearings; 04 (C) stipulated agreements; 05 (2) on a year-to-year basis for legal services provided to the commission by 06 the Department of Law for 07 (A) general legal advice during the course of investigations; 08 (B) defending the commission in legal actions. 09 (c) The mission of the Alaska State Council on the Arts (ASCA) is to encourage 10 lifelong participation in the state's artistic diversity. 11 (d) The legislature intends to measure the success of the council in achieving its 12 mission by considering the 13 (1) year to year change in ratio of nonstate funds to state funds appropriated to 14 ASCA; 15 (2) percentage of administration costs compared to grants issued; 16 (3) percentage change of artists and of vendors participating in the Silver 17 Hand program. 18 * Sec. 49. DOEED - Alaska Vocational Technical Center. (a) The mission of the 19 Alaska Vocational Technical Center is to provide market-driven vocational and technical 20 training to state residents. 21 (b) The legislature intends to measure the success of the center in achieving its 22 mission by considering the 23 (1) change when compared to the prior fiscal year in the percentage of 24 graduates employed in their areas of training; 25 (2) change when compared to the prior fiscal year in the wage increase 26 realized by graduates of training programs; 27 (3) change when compared to the prior fiscal year in the percentage of 28 students who complete long-term training programs; 29 (4) change when compared to the prior fiscal year in the percentage of 30 students living in student housing compared to student-housing capacity; and 31 (5) change when compared to the prior fiscal year for each long-term program,

01 the percentage of students who applied to the program who actually enrolled in the program. 02 * Sec. 50. DOEED - Mt. Edgecumbe High School. (a) The mission of Mt. Edgecumbe 03 High School is to provide a residential high school for Alaska students. 04 (b) The legislature intends to measure the success of the school in achieving its 05 mission by considering 06 (1) the percentage of applicants who are admitted to the school; 07 (2) the percentage of students enrolled at Mt. Edgecumbe High School who 08 take and pass the state high school qualifying exam in the current school year; 09 (3) the percentage of students in a high school grade level at Mt. Edgecumbe 10 who pass the state high school graduation qualifying exam on a cumulative basis; 11 (4) the average duration of an individual student's enrollment at the school; 12 (5) the percentage of graduates who enroll in a postsecondary education 13 institution or program; and 14 (6) the total state cost per student (set out as instructional costs and residential 15 costs) at Mt. Edgecumbe High School compared to the per student cost for high school 16 students in the school districts in the students' home communities. 17 * Sec. 51. DOEED - Division of Libraries, Archives, and Museums. (a) The mission of 18 the Division of Libraries, Archives, and Museums is to 19 (1) provide access to information; 20 (2) preserve the history of the state; and 21 (3) encourage and facilitate the transfer of library services and training to local 22 governments. 23 (b) The legislature intends to measure the success of the division in achieving its 24 mission for libraries by considering the 25 (1) number of training and continuing education sessions and on-site visits to 26 libraries requested and actually provided and the number of libraries affected; 27 (2) number of school and public libraries assisted in gaining access to and 28 improving ability to use the Internet; 29 (3) use of library resources broken out by type of material and method of 30 access, including books and documents, periodicals, interlibrary loan, and Internet access to 31 state library data bases and information;

01 (4) number of reference requests received and answered or referred elsewhere; 02 (5) number of items added to collections broken out by type of material, 03 including books, government documents, and special materials; 04 (6) timeliness of making new items available to the public. 05 (c) The legislature intends to measure the success of the division in achieving its 06 mission for archives by considering the 07 (1) average time taken from the division's receipt of archival material to the 08 time that it is made available to the public; 09 (2) average time taken to respond to public information requests; 10 (3) percentage of records available in searchable electronic format. 11 (d) The legislature intends to measure the success of the division in achieving its 12 mission for museums by considering the number of 13 (1) training and continuing education sessions and on-site visits to museums 14 requested and actually provided and the number of museum staff affected; 15 (2) general and technical information requests received and answered or 16 referred elsewhere; 17 (3) visitors to the museum as a percentage of the total number of visitors to the 18 city, broken out by city (Juneau and Sitka); 19 (4) volunteers and volunteer hours contributed to the museums broken out by 20 facility; 21 (5) sites exhibiting the state museum's traveling exhibits and total number of 22 individuals viewing them. 23 * Sec. 52. DOEED - Alaska Commission on Postsecondary Education. (a) The mission 24 of the Alaska Commission on Postsecondary Education is to 25 (1) provide postsecondary educational financial assistance to Alaskans, 26 including offering loan rates and conditions competitive with and less than those offered by 27 the private sector; 28 (2) authorize the operation of postsecondary institutions in the state. 29 (b) The legislature intends to measure the success of the commission in achieving its 30 mission by considering the 31 (1) cost to students of financial aid from the commission compared to other

01 financial aid; 02 (2) percentage of loans issued by the commission that are in default; 03 (3) change in the defaulted loan recovery rate; 04 (4) percentage of the secondary school population receiving outreach services 05 and the change in percentage; 06 (5) percentage of postsecondary students receiving financial aid services from 07 the commission and the change in percentage; 08 (6) percentage of Department of Labor and Workforce Development job 09 centers receiving outreach services and the changes in percentage; 10 (7) percentage of college-age Alaskans attending postsecondary educational 11 institutions and the change in percentage. 12 * Sec. 53. DOEED - WWAMI. (a) The mission of the Alaska Commission on 13 Postsecondary Education in administering the WWAMI program is to improve the general 14 health of state residents. 15 (b) The legislature intends to measure the success of the WWAMI program by 16 considering the percentage 17 (1) change in the number of Alaska communities with access to medical 18 services associated with WWAMI/UW; 19 (2) of WWAMI participants who return to the state to practice medicine; 20 (3) change in the number of patient visits provided to Alaskans through 21 programs and physicians associated with the University of Washington School of Medicine 22 WWAMI program; 23 (4) change in the number of health-related programs developed in the state 24 that are associated with WWAMI/UW; and 25 (5) change in the number of research projects in or about the state associated 26 with the University of Washington School of Medicine WWAMI program. 27 Article 5. Department of Environmental Conservation. 28 * Sec. 54. Department of Environmental Conservation. The mission of the Department 29 of Environmental Conservation is to protect human health and the environment. 30 * Sec. 55. DEC - Office of the Commissioner. (a) The mission of the Office of the 31 Commissioner is to provide support and policy direction to the divisions in the department.

01 (b) The legislature intends to measure the success of the office in achieving its 02 mission by considering the 03 (1) percentage of divisions that meet assigned performance measures; 04 (2) percentage of permittees out of compliance with state statute or regulation; 05 (3) percentage of change when compared to the prior fiscal year in the number 06 of critical violations in inspected public or private facilities that significantly affect the health 07 or safety of the public; 08 (4) average time taken to adjudicate decisions in permit disputes; 09 (5) percentage of adjudicated decisions that are appealed to the courts; 10 (6) average time taken to respond to complaints and questions that have been 11 elevated to the commissioner's office. 12 * Sec. 56. DEC - Division of Administrative Services. (a) The mission of the Division of 13 Administrative Services is to provide support services to departmental programs. 14 (b) The legislature intends to measure the success of the division in achieving its 15 mission by considering the 16 (1) percentage of employee complaints and grievances filed and resolved at 17 the departmental level as compared to all other departments; 18 (2) percentage of employee grievances overturned by hearing officers as 19 compared to all other departments; 20 (3) percentage of indirect costs collected for the commissioner and the 21 administrative services division and for shared overhead costs; 22 (4) percentage of penalties for total payroll or vendor payments per year; 23 (5) change when compared to the prior fiscal year in percentage of audit 24 exceptions resolved. 25 * Sec. 57. DEC - Division of Environmental Health. (a) The mission of the Division of 26 Environmental Health is to protect consumers from food- and water-borne illness. 27 (b) The legislature intends to measure the success of the division in achieving its 28 mission by considering the 29 (1) change in the cost per 30 (A) permitted facility; and 31 (B) nonpermitted facility;

01 (2) change when compared to the prior fiscal year in percentage of "boil 02 water" notices issued, the population affected, and the duration for the year; 03 (3) percentage of sanitary surveys that result in significant compliance 04 violations; 05 (4) percentage of landfills with a permit or an alternative to a permit; 06 (5) percentage of landfills with an inspection score of 80 or higher; 07 (6) change when compared to the prior fiscal year in percentage of critical 08 violations affecting food safety; 09 (7) percentage of facilities inspected according to risk-based inspection 10 frequency. 11 * Sec. 58. DEC - Division of Air and Water Quality. (a) The mission of the Division of 12 Air and Water Quality is to protect air and water quality. 13 (b) The legislature intends to measure the success of the division in achieving its 14 mission by considering 15 (1) the change when compared to the prior fiscal year in the cost per permit 16 issued; 17 (2) whether the carbon monoxide levels in Fairbanks and Anchorage meet 18 health standards; 19 (3) the average time taken in days from receipt of a permit application to 20 approval; 21 (4) the average time taken from receipt of a permittee complaint to resolution 22 of the complaint; 23 (5) the percentage of facilities inspected according to risk-based inspection 24 frequency; 25 (6) the percentage of fast-track general permits as compared to the total 26 number of permits. 27 * Sec. 59. DEC - Division of Spill Prevention and Response. (a) The mission of the 28 Division of Spill Prevention and Response is to reduce unlawful oil and hazardous substance 29 contamination in the environment. 30 (b) The legislature intends to measure the success of the division in achieving its 31 mission by considering the

01 (1) number of oil spills greater than one gallon per year compared to the 02 number of spills requiring a response; 03 (2) number of hazardous substance spills compared to the number of 04 hazardous substance spills requiring response; 05 (3) time the division takes from receiving a report of a spill to the 06 determination of "no further action"; 07 (4) average annual state cleanup costs per spill; 08 (5) average annual state cleanup costs per contaminated site; 09 (6) average annual environmental hazard per contaminated site; 10 (7) percentage of underground storage tank owners required to clean up a site 11 who are issued "no further action" letters during the year; 12 (8) average time to approve oil spill prevention contingency plans as 13 compared to the prior year. 14 * Sec. 60. DEC - Division of Facility Construction and Operation. (a) The mission of 15 the Division of Facility Construction and Operation is to assist communities in improving 16 sanitation conditions. 17 (b) The legislature intends to measure the success of the division in achieving its 18 mission by considering the 19 (1) agency operating costs per sanitation project; 20 (2) number and cost of sanitation projects per division engineer; 21 (3) cost per household served; 22 (4) percentage of households with improved sanitation systems; 23 (5) actual life cycle cost compared to the design life cycle cost per year. 24 Article 6. Department of Fish and Game. 25 * Sec. 61. Department of Fish and Game. The mission of the Department of Fish and 26 Game is to protect, maintain, and improve the fish, game, and aquatic plant resources of the 27 state, and manage their use and development for the maximum benefit of the people of the 28 state, consistent with the sustained yield principle. 29 * Sec. 62. DF&G - Division of Commercial Fisheries. (a) The mission of the Division of 30 Commercial Fisheries is to protect, maintain, and improve fisheries, aquatic farms, and 31 aquatic plant resources of the state, and manage their use and development for the maximum

01 benefit of the people of the state, consistent with the sustained yield principle and subject to 02 allocations through public regulatory processes. 03 (b) The legislature intends to measure the success of the division in achieving its 04 mission by considering, as compared to each of the previous five years, the 05 (1) number of salmon escapement objectives met compared to the total 06 number of objectives set per region; 07 (2) number of harvest objectives met compared to the total number of 08 objectives set per region, excluding objectives involving salmon; 09 (3) number of allocation objectives met compared to the total number of 10 objectives set per region; 11 (4) number of applications, resource assessment plans developed, and resource 12 assessment projects initiated in response to proposals from the public to develop new 13 fisheries; 14 (5) number of aquatic farms applications received, aquatic farm applications 15 approved, and aquatic farms in operation. 16 * Sec. 63. DF&G - Division of Sport Fish. (a) The mission of the Division of Sport Fish 17 is to protect and improve the state's recreational fisheries resources and manage their use and 18 development for the maximum benefit of the people of the state, consistent with the sustained 19 yield principle. 20 (b) The legislature intends to measure the success of the division in achieving its 21 mission by considering, for river systems that support a sport harvest of 100 or more king 22 salmon and as compared to each of the previous five years, the number and percentage 23 (1) for which an escapement goal is established; 24 (2) for which enumeration occurs annually; 25 (3) of escapement objectives achieved annually. 26 (c) The legislature intends to measure the success of the division in achieving its 27 mission by considering, as compared to each of the previous five years, the 28 (1) number of fishing licenses sold and the total revenue generated; 29 (2) percentage of Alaska residents between the ages of 16 and 59 who 30 purchase fishing licenses; 31 (3) number of anadromous and nonanadromous stocking sites, and the total

01 number of fish stocked. 02 (d) The legislature intends that unsuccessful angler days not be used as a measure of 03 success of the division. 04 * Sec. 64. DF&G - Division of Wildlife Conservation. (a) The mission of the Division 05 of Wildlife Conservation is to conserve and enhance Alaska's wildlife and to provide for a 06 wide range of uses for people. 07 (b) The legislature intends to measure the success of the division in achieving its 08 mission by considering, as compared to each of the previous five years, the 09 (1) number of big game surveys completed for populations identified by the 10 Board of Game as important for providing high levels of human consumptive use; 11 (2) number of hunting and trapping licenses sold and the total revenue 12 generated; 13 (3) percentage of Alaska residents between the ages of 16 and 59 who 14 purchase hunting or trapping licenses; 15 (4) number of drawing permits applied for each year and the total number of 16 drawing permits issued by species; 17 (5) number of tier II permits applied for each year and the total number of tier 18 II permits issued by game management unit; 19 (6) total number of visitors visiting the state's wildlife viewing areas at Pack 20 Creek, McNeil River, and Creamer's Field. 21 * Sec. 65. DF&G - Office of the Commissioner and Division of Administrative 22 Services. (a) The missions of the Office of the Commissioner and the Division of 23 Administrative Services are to provide support and policy directions to departmental 24 programs. 25 (b) The legislature intends to measure the success of the office and the division in 26 achieving their missions by considering, as compared to each of the previous five years, the 27 (1) number and percentage of fish and game licenses sold through an 28 automated process; 29 (2) number of issues that the Boards of Fisheries and Game must consider out 30 of cycle; 31 (3) number and percentage of advisory committees from a region that meet in

01 a year that the board cycles through their region. 02 * Sec. 66. DF&G - Division of Subsistence. (a) The mission of the Division of 03 Subsistence is to 04 (1) gather, quantify, evaluate, and report data about uses, users, and methods 05 of subsistence hunting and fishing; and 06 (2) make recommendations on the impacts of federal and state laws and 07 regulations on subsistence uses and users. 08 (b) The legislature intends to measure the success of the division in achieving its 09 mission by considering, as compared to each of the previous five years, the 10 (1) number and percentage of Alaska communities in each region for which 11 fisheries harvest data are collected and reported; 12 (2) number and percentage of Alaska communities in each region for which 13 wildlife harvest data are collected and reported; 14 (3) number and percentage of subsistence proposals at meetings of the Board 15 of Fisheries and the Board of Game for which subsistence data are assessed and 16 recommendations are made; 17 (4) number of proposed statutory and regulatory changes by federal and other 18 state entities for which subsistence data are assessed and recommendations are made. 19 * Sec. 67. DF&G - Division of Habitat and Restoration. Due to the reorganization of the 20 division, it is the intent of the legislature to craft a new mission statement and subsequent 21 measures appropriate to the remaining functions of the division during the Second Regular 22 Session of the Twenty-Third Alaska State Legislature. 23 * Sec. 68. DF&G - Commercial Fisheries Entry Commission. (a) The mission of the 24 Commercial Fisheries Entry Commission is to limit entry into commercial fisheries for 25 purposes of resource conservation and to prevent economic distress among fishermen and 26 those dependent on them for a livelihood. 27 (b) The legislature intends to measure the success of the commission in achieving its 28 mission by considering, as compared to each of the previous five years, whether the 29 commission 30 (1) processes 90 percent of all vessel licenses, permit renewals, and requests 31 for duplicates within three days after receipt of a fully completed application;

01 (2) processes 90 percent of all emergency transfer requests within four days 02 after receipt of a fully completed application; 03 (3) processes 90 percent of all permanent transfer requests within five days 04 after receipt of a fully completed application; 05 (4) maintains the number of hearing officer and paralegal decisions issued 06 during the year at 70 or more; 07 (5) maintains the number of final decisions issued by the commission during 08 the year at 100 or more; 09 (6) by the end of the fiscal year, maintains or decreases the net number of 10 cases pending before hearing officers and the commissioners from the number that are 11 pending at the beginning of the fiscal year; 12 (7) maintains at 20 percent or less the number of appeals from final decisions 13 of the commission that are filed with the superior court during the year. 14 Article 7. Department of Health and Social Services. 15 * Sec. 69. Department of Health and Social Services. The mission of the Department of 16 Health and Social Services is to promote and protect the health and well-being of Alaskans. 17 * Sec. 70. DHSS - Division of Public Assistance. (a) The mission of the Division of 18 Public Assistance is to promote self-sufficiency and provide basic living expenses to Alaskans 19 in need. 20 (b) The legislature intends to measure the success of the division in achieving its 21 mission by considering the 22 (1) percentage of the Alaska temporary assistance program (ATAP) 23 (AS 47.27) families meeting federal work participation rates; 24 (2) percentage of closed cases with earnings and that remain off temporary 25 assistance six months after closure; 26 (3) percentage of adults receiving temporary assistance who have earned 27 income; 28 (4) percentage by region of temporary assistance clients with wage 29 progression; 30 (5) rate of payment accuracy for ATAP payments and food stamps; 31 (6) number of clients receiving 60-month waivers.

01 * Sec. 71. DHSS - Division of Health Care Services. (a) The mission of the Division of 02 Health Care Services is to maintain access to health care and to provide health coverage for 03 Alaskans in need. 04 (b) The legislature intends to measure the success of the division in achieving its 05 mission by considering the 06 (1) average, median, minimum, and maximum time the division takes from 07 receiving a claim to paying it; 08 (2) percentage of claims with no errors categorized by the type of provider; 09 (3) percentage of total funds that are used to pay claims compared to the 10 percentage used for administration of the division; 11 (4) percentage of providers who are participating in the medical assistance 12 program by region; 13 (5) percentage of audit recommendations from Legislative Audit report 14 number 06-30018-03 that are resolved. 15 * Sec. 72. DHSS - Office of Children's Services. (a) The mission of the Office of 16 Children's Services is to protect children who are abused and neglected or at risk of abuse and 17 neglect. 18 (b) The legislature intends to measure the success of the division in achieving its 19 mission by considering the 20 (1) percentage of children in foster care who had experienced substantiated or 21 indicated maltreatment by a foster care parent or facility staff person; 22 (2) percentage of children who exited care to a final adoption in less than 24 23 months after the date of latest removal from the home when compared to the total number of 24 children who exited care to a final adoption; 25 (3) percentage of children who reentered foster care within 12 months after a 26 prior entry compared to the total number of children entered into foster care; 27 (4) percentage of children reunified with parents or caregivers within 30 days, 28 90 days, six months, and 12 months after removal; 29 (5) total percentage of children that are reunified with parents or caregivers in 30 less than 12 months; 31 (6) percentage of legitimate reports of harm that are investigated;

01 (7) average number of children placed into foster care; 02 (8) average, median, minimum, and maximum social worker caseload by 03 region; 04 (9) percentage of families who are qualified under federal guidelines for the 05 services of the infant learning program. 06 * Sec. 73. DHSS - Division of Juvenile Justice. (a) The mission of the Division of 07 Juvenile Justice is to protect and restore communities and victims while holding juvenile 08 offenders accountable for correcting their behavior. 09 (b) The legislature intends to measure the success of the division in achieving its 10 mission by considering the 11 (1) percentage of ordered restitution and community work service that is paid 12 or performed by the juvenile offender; 13 (2) number of escapes from juvenile justice institutions; 14 (3) rate of recidivism of youth in the juvenile justice system by region and by 15 race; 16 (4) number of juvenile offenders who are maltreated while in state custody; 17 (5) number of the victims of juvenile crime reporting dissatisfaction with the 18 juvenile justice system. 19 * Sec. 74. DHSS - Division of Public Health. (a) The mission of the Division of Public 20 Health is to preserve and promote the state's public health. 21 (b) The legislature intends to measure the success of the division in achieving its 22 mission by considering the 23 (1) percentage of two-year-old children in the state who are fully immunized; 24 (2) rate of tuberculosis cases by race and region; 25 (3) rate of child hospitalizations and fatalities related to injury; 26 (4) rate of hepatitis C cases; 27 (5) rate of unmarried and married teen births; 28 (6) rate of new cases of sexually transmitted diseases. 29 * Sec. 75. DHSS - Division of Behavioral Health. (a) The mission of the Division of 30 Behavioral Health is to reduce alcoholism and substance abuse, and to improve and enhance 31 the quality of life for people affected by mental disorders.

01 (b) The legislature intends to measure the success of the division in achieving its 02 mission by considering the 03 (1) rate of binge or chronic drinking by age group; 04 (2) rate of drug and inhalant abuse by age group and region; 05 (3) number of new convictions and the number of repeat convictions in state 06 district and superior courts on charges of driving while intoxicated (DWI); 07 (4) number and rate of infants affected by prenatal exposure to alcohol by 08 region; 09 (5) number of new admissions as a percentage of the total admissions to 10 treatment programs for alcohol and drug abuse; 11 (6) average length of time that alcohol or other drug treatment clients are on 12 waiting lists before receiving services; 13 (7) number of juvenile clients who return for treatment within six and 12 14 months of being discharged from a residential alcohol or drug abuse treatment program; 15 (8) percentage of people receiving mental health services who show improved 16 functioning as a result of the services; 17 (9) percentage of programs designated by the department that are reviewed for 18 consumer satisfaction; 19 (10) average length of stay at the Alaska Psychiatric Institute. 20 * Sec. 76. DHSS - Division of Senior and Disability Services. (a) The mission of the 21 Division of Senior and Disability Services is to maximize the independence of older Alaskans 22 and improve the quality of life for Alaskans with developmental disabilities. 23 (b) The legislature intends to measure the success of the division in achieving its 24 mission by considering the 25 (1) percentage of consumers with developmental disabilities who received 26 some form of interim services while on the waiting list; 27 (2) average, median, minimum, and maximum length of time that 28 developmentally disabled consumers are on a waiting list before receiving full services; 29 (3) average length of time taken to investigate complaints received about 30 assisted living homes; 31 (4) average length of time taken to respond to reports of harm to vulnerable

01 adults; 02 (5) average length of time taken to qualify for Project Choice or the Adults 03 with Physical Disabilities waiver; 04 (6) percentage of Alaska with Alzheimer's disease and related disorders who 05 are served through home-based and community-based programs. 06 * Sec. 77. DHSS - Office of the Commissioner. (a) The mission of the Office of the 07 Commissioner is to provide leadership and policy direction to the divisions within the 08 department. 09 (b) The legislature intends to measure the success of the office in achieving its 10 mission by considering the 11 (1) percentage of divisions within the department that meet assigned 12 performance measures; 13 (2) average time taken to respond to complaints and questions that have been 14 elevated to the commissioner's office; 15 (3) turnover and vacancy rates by division and job class; 16 (4) success in having the state's position upheld in the Medicaid "Fair Share" 17 issue. 18 * Sec. 78. DHSS - Division of Administrative Services. (a) The mission of the Division 19 of Administrative Services is to provide quality administrative services that support the 20 department's programs. 21 (b) The legislature intends to measure the success of the division in achieving its 22 mission by considering the 23 (1) cost of administrative services personnel as compared to the cost of the 24 entire department's personnel; 25 (2) percentage of grievances and complaints resolved without resort to 26 arbitration; 27 (3) average number of days taken for vendor payments; 28 (4) percentage of audit exceptions that are resolved. 29 * Sec. 79. DHSS - Division of Alaska Longevity Programs. (a) The mission of the 30 Division of Alaska Longevity Programs is to issue longevity bonus payments to eligible 31 individuals and manage the Alaska Pioneers' Homes.

01 (b) The legislature intends to measure the success of the division in achieving its 02 mission by considering the 03 (1) change in the average number of vacancies in the Alaska Pioneers' Homes 04 measured by month by level of care and Pioneer Home; 05 (2) percentage of change when compared to the prior fiscal year in the number 06 of incidents in Alaska Pioneers' Homes resulting in resident injury as compared to the national 07 average for similar facilities; 08 (3) medication error rate in Alaska Pioneers' Homes as compared to the 09 national average for similar facilities. 10 Article 8. Department of Labor and Workforce Development. 11 * Sec. 80. Department of Labor and Workforce Development. The mission of the 12 Department of Labor and Workforce Development is to provide safe and legal working 13 conditions and to advance opportunities for employment. 14 * Sec. 81. DOLWD - Division of Employment Security. (a) The mission of the Division 15 of Employment Security is to promote employment opportunities and provide unemployment 16 insurance. 17 (b) The legislature intends to measure the success of the division in achieving its 18 mission by considering the 19 (1) number of registered clients who enter employment after receiving 20 services through an Alaska Job Center and, compared to the prior fiscal year, the percentage 21 of change in that number; 22 (2) timeliness of initial payments to unemployment insurance claimants; 23 (3) number of employers who are satisfied with the public labor exchange 24 services they received. 25 * Sec. 82. DOLWD - Division of Administrative Services. (a) The mission of the 26 Division of Administrative Services is to provide support to the department. 27 (b) The legislature intends to measure the success of the division in achieving its 28 mission by considering the 29 (1) cost of the management services component compared to personnel costs 30 for the department; 31 (2) percentage of penalties incurred for late vendor payments and the number

01 of occurrences. 02 * Sec. 83. DOLWD - Office of the Commissioner. (a) The mission of the Office of the 03 Commissioner is to provide support and policy direction to divisions within the department. 04 (b) The legislature intends to measure the success of the office in achieving its 05 mission by considering the 06 (1) percentage of assigned performance measures met by the department; 07 (2) percentage of financial audit exceptions resolved; 08 (3) average time taken to respond to complaints and questions that have been 09 elevated to the commissioner's office. 10 * Sec. 84. DOLWD - Division of Workers' Compensation. (a) The mission of the 11 Division of Workers' Compensation is to ensure that injured Alaska workers receive benefits 12 as defined by law. 13 (b) The legislature intends to measure the success of the division in achieving its 14 mission by considering the 15 (1) average time taken from a compensation hearing request until the date on 16 which the hearing is scheduled; 17 (2) number of cases filed before the Workers' Compensation Board compared 18 to the number of requests for hearing; 19 (3) average time taken for completion of a Fishermen's Fund claim; 20 (4) number of uninsured workplace injuries; 21 (5) average time taken for completion of a Second Injury Fund petition. 22 * Sec. 85. DOLWD - Division of Labor Standards and Safety. (a) The mission of the 23 Division of Labor Standards and Safety is to provide for the monitoring of safe and legal 24 working conditions. 25 (b) The legislature intends to measure the success of the division in achieving its 26 mission by considering the 27 (1) injury incident rate for lost workdays in high-hazard industries, including 28 seafood processing, logging, and construction; 29 (2) number of verified abatements compared to the number of violations 30 identified during enforcement inspections; 31 (3) percentage of wage claims settled;

01 (4) number of boiler and pressure vessel inspections completed compared to 02 the backlog; 03 (5) number of boiler and pressure vessel violations abated compared to the 04 number detected. 05 * Sec. 86. DOLWD - Division of Vocational Rehabilitation. (a) The mission of the 06 Division of Vocational Rehabilitation is to assist individuals with disabilities to obtain and 07 maintain employment. 08 (b) The legislature intends to measure the success of the division in achieving its 09 mission by considering the 10 (1) number of people served in post-employment services; 11 (2) percentage of Alaskans who apply for services compared to the number 12 determined eligible and served; 13 (3) increase in wages of clients who are served by the division; 14 (4) number of individuals who enter and retain employment for at least 90 15 days after receiving services from the division; 16 (5) number of individuals placed in jobs who require additional services from 17 the division after one full year. 18 * Sec. 87. DOLWD - Division of Business Partnerships. (a) The mission of the Division 19 of Business Partnerships is to provide a workforce designed to meet Alaska employers' needs. 20 (b) the legislature intends to measure the success of the division in achieving its 21 mission by considering the 22 (1) percentage of Alaskans who enter and retain employment after receiving 23 training through the state training and employment program; 24 (2) percentage of eligible WIA Adult Job Training participants who are placed 25 into full-time jobs and who retain work at least six months after training; 26 (3) average cost of assisting a client to find employment. 27 Article 9. Department of Law. 28 * Sec. 88. Department of Law. The mission of the Department of Law is to provide legal 29 services to state government and to prosecute crime. 30 * Sec. 89. DLaw - Criminal Division. (a) The mission of the Criminal Division is to 31 prosecute criminal cases.

01 (b) The legislature intends to measure the success of the division in achieving its 02 mission by considering, for each Criminal Division budget component, the number of 03 (1) violent felony prosecutions; 04 (2) felony drug case prosecutions; 05 (3) misdemeanor domestic violence assault prosecutions; 06 (4) felony property prosecutions; 07 (5) felony drunk driving prosecutions; 08 (6) misdemeanor drunk driving prosecutions; 09 (7) felony cases in which charges that were initially accepted for prosecution 10 are later reduced; and 11 (8) misdemeanor cases in which charges that were initially accepted for 12 prosecution are later reduced. 13 * Sec. 90. DLaw - Office of Special Prosecutions and Appeals. (a) The mission of the 14 Office of Special Prosecutions and Appeals is to prosecute complex cases and to uphold the 15 state's position on appeals. 16 (b) The legislature intends to measure the success of the office in achieving its 17 mission by considering the 18 (1) number of new criminal cases reviewed for prosecution; 19 (2) number of criminal cases resolved; 20 (3) number of new appeals and petitions opened; 21 (4) number of appeals and petitions resolved; 22 (5) average cost per criminal case reviewed; 23 (6) average cost per appeal or petition opened. 24 * Sec. 91. DLaw - Civil Division. (a) The mission of the Civil Division is to protect the 25 human, financial, and natural resources of the state. 26 (b) The legislature intends to measure the success of the division in achieving its 27 mission by considering the 28 (1) monetary value of disputed oil and gas taxes received by the state, whether 29 obtained through court judgment or settlement; 30 (2) monetary value of disputed oil and gas royalties received, whether 31 obtained through court judgment or settlement;

01 (3) monetary value of the criminal and civil judgments collected, including 02 indigent defense costs, costs of incarceration for offenders convicted of driving while 03 intoxicated, and other fines and costs owed to the state, and the number of civil and criminal 04 judgments satisfied in full; 05 (4) number of new case files opened, categorized by type of case, for each 06 year for the past 10 years; 07 (5) number of new cases opened relating to protecting children in the state 08 against abuse and neglect; 09 (6) percentage of child abuse and neglect cases completed in the permanency 10 placement backlog; 11 (7) percentage of other child abuse and neglect cases that are resolved within 12 the statutory deadline of no more than 21 months of out-of-home placement; 13 (8) number of child support enforcement cases completed; 14 (9) number of collections of civil and criminal judgments overseen by the 15 collections unit. 16 * Sec. 92. DLaw - Office of the Attorney General. (a) The mission of the Office of the 17 Attorney General is to provide support and direction to divisions within the department, 18 allocate resources, and represent the state in civil and criminal actions. 19 (b) The legislature intends to measure the success of the office in achieving its 20 mission by considering 21 (1) the cost of legal services rendered on behalf of each state agency; 22 (2) whether the divisions and offices in the department meet the performance 23 measures set out in secs. 93 - 98 of this Act; and 24 (3) the average time taken to respond to complaints and questions that have 25 been elevated to the Office of the Attorney General. 26 * Sec. 93. DLaw - Division of Administrative Services. (a) The mission of the Division 27 of Administrative Services is to provide support services to departmental programs. 28 (b) The legislature intends to measure the success of the division in achieving its 29 mission by considering the 30 (1) cost of the division compared to personnel costs for the department; 31 (2) number of late penalties incurred for payroll or vendor payments;

01 (3) number of audit exceptions. 02 Article 10. Department of Military and Veterans' Affairs. 03 * Sec. 94. Department of Military and Veterans' Affairs. The mission of the 04 Department of Military and Veterans' Affairs is to 05 (1) provide military forces capable of ready operations; 06 (2) provide for an organized response during emergencies and disasters; 07 (3) train at-risk juveniles; 08 (4) coordinate veterans' programs; and 09 (5) assist agencies in suppressing illegal drugs. 10 * Sec. 95. DMVA - Division of Emergency Services. (a) The mission of the Division of 11 Emergency Services is to maintain a statewide, integrated emergency management system to 12 protect lives and property. 13 (b) The legislature intends to measure the success of the division in achieving its 14 mission by considering 15 (1) preparedness as measured by the "after action" reports; 16 (2) whether the division closed out disasters within an average of 18 months; 17 (3) the state funds expended during actual events. 18 * Sec. 96. DMVA - Alaska National Guard. (a) The mission of the Alaska National 19 Guard is to provide a force that fulfills state and federal military missions and that is capable 20 of protecting life and property, preserving peace and order, and enhancing public safety. 21 (b) The legislature intends to measure the success of the Alaska National Guard in 22 achieving its mission by considering 23 (1) whether the guard meets military efficiency and readiness ratings; 24 (2) the adequacy of response time for each emergency; 25 (3) the number of persons assisted during actual events; 26 (4) whether the guard meets recruitment and retention goals established by the 27 National Guard; 28 (5) whether the guard acquires new missions while minimizing the cost to the 29 state. 30 * Sec. 97. DMVA - Office of the Commissioner. (a) The mission of the Office of the 31 Commissioner is to provide support and policy direction to divisions within the department.

01 (b) The legislature intends to measure the success of the office in achieving its 02 mission by considering the 03 (1) percentage of divisions that meet assigned performance measures; 04 (2) average time taken to respond to complaints and questions that have been 05 elevated to the commissioner's office. 06 * Sec. 98. DMVA - Division of Administrative Services. (a) The mission of the Division 07 of Administrative Services is to support and provide support services to departmental 08 programs. 09 (b) The legislature intends to measure the success of the division in achieving its 10 mission by considering the 11 (1) percentage of costs applicable to administrative services as compared to 12 the total personnel costs for the department; 13 (2) percentage of late penalties compared to total payroll payments; 14 (3) average vendor payment time; 15 (4) number of audit exceptions. 16 * Sec. 99. DMVA - National Guard Facilities Management. (a) The mission of the 17 department with respect to National Guard facilities management is to operate safe and secure 18 facilities and areas for the National Guard. 19 (b) The legislature intends to measure the success of the department in achieving its 20 mission with respect to National Guard facilities management by considering 21 (1) the percentage reduction in accrued deferred maintenance projects; 22 (2) the change in the number of days lost due to facility-related accidents; 23 (3) expenditures and estimated cost savings related to energy efficiency 24 measures applied to state and federal facilities; 25 (4) the cost per square foot to operate and maintain Alaska National Guard 26 facilities during a federal fiscal year. 27 * Sec. 100. DMVA - Alaska Military Youth Academy. (a) The mission of the Alaska 28 Military Youth Academy is to help at-risk youth to gain an education and learn self-discipline. 29 (b) The legislature intends to measure the success of the youth academy in achieving 30 its mission by considering the 31 (1) percentage of cadets who receive their high school diplomas or

01 equivalencies by completion of Phase III; 02 (2) percentage of cadets increasing English comprehension a minimum of one 03 grade level at the completion of Phase II; 04 (3) percentage of cadets increasing math comprehension a minimum of one 05 grade level at the completion of Phase II; 06 (4) percentage of cadets who graduate from Phase II; 07 (5) percentage of cadets who are working or in school, including continuing 08 education, one year after completion of Phase II; 09 (6) cost of the program per registered cadet. 10 * Sec. 101. DMVA - Office of Veterans' Affairs. (a) The mission of the Office of 11 Veterans' Affairs is to advocate for veterans' benefits for veterans and their families. 12 (b) The legislature intends to measure the success of the office in achieving its 13 mission by considering the 14 (1) number of contacts with persons seeking information about veterans' 15 benefits; 16 (2) number of trips to assist rural veterans; 17 (3) change in the number of veterans served each year; 18 (4) change in the estimated monetary value of benefits obtained; 19 (5) ratio of cost to estimated value of monetary benefits obtained. 20 Article 11. Department of Natural Resources. 21 * Sec. 102. Department of Natural Resources. The mission of the Department of Natural 22 Resources is to develop, conserve, and maximize the use of Alaska's natural resources 23 consistent with the public interest. 24 * Sec. 103. DNR - Office of the Commissioner. (a) The mission of the Office of the 25 Commissioner is to provide support and policy direction to each of the divisions within the 26 department. 27 (b) The legislature intends to measure the success of the office in achieving its 28 mission by considering the 29 (1) percentage of the assigned performance measures met by the department; 30 (2) percentage of maintained daily entry and weekly verification of the on-line 31 grantor/grantee and location indexing process for all documents accepted in the recorders'

01 offices; 02 (3) percentage of time the computer systems are able to support the annual 03 volume of land and recorded transactions; 04 (4) revenue generated by the development and sale of natural resources; 05 (5) average time taken to respond to complaints and questions that have been 06 elevated to the commissioner's office; 07 (6) average time taken to respond to appeals and reconsiderations that have 08 been elevated from the divisions to the commissioner's office. 09 * Sec. 104. DNR - Administrative Services. (a) The mission of Administrative Services 10 is to provide support services for departmental programs. 11 (b) The legislature intends to measure the success of Administrative Services in 12 achieving its mission by considering the 13 (1) average time taken to pay vendors; 14 (2) number of late penalties for payroll or vendor payments; 15 (3) number of audit exceptions; 16 (4) cost of administrative services as compared to the total personnel costs for 17 the department. 18 * Sec. 105. DNR - Division of Forestry. (a) The mission of the Division of Forestry is to 19 develop, conserve, enhance, and manage the state's forests to provide a sustainable yield of 20 forest resources for Alaska and to manage the wildland fire suppression program. 21 (b) The legislature intends to measure the success of the division in achieving its 22 mission by considering the 23 (1) level and areas of noncompliance with AS 41.17 (Forest Resources and 24 Practices Act) measured by the annual number of field visits and violations; 25 (2) annual volume of state timber sold as compared to the amount offered for 26 sale; 27 (3) acreage of 28 (A) state forest land with active insect infestations or diseases; 29 (B) infested or diseased timber offered for sale on state land; and 30 (C) infested or diseased timber sold on state land; 31 (4) annual volume of state timber offered for in-state companies and converted

01 to value-added products; 02 (5) number of fires that result from human actions, whether as a function of 03 population growth or other causes; 04 (6) percentage of fires in full and critical protection categories that are held to 05 less than 10 acres. 06 * Sec. 106. DNR - Division of Oil and Gas. (a) The mission of the Division of Oil and 07 Gas is to maximize responsible oil and gas exploration and development. 08 (b) The legislature intends to measure the success of the division in achieving its 09 mission by considering 10 (1) compliance with the areawide leasing plan and exploration licensing; 11 (2) the amount of available state acreage offered for oil and gas leasing or for 12 exploration that is 13 (A) licensed for exploration; 14 (B) leased for oil and gas development; 15 (C) leased for shallow natural gas development; 16 (3) the non-tax revenue received for total state production of oil and gas; 17 (4) the number of resident and nonresident private-sector jobs in the oil and 18 gas industry in the state; 19 (5) the number of new and assigned oil and gas rights, plans, and units; 20 (6) the total amount of oil and gas acreage 21 (A) under lease or license; 22 (B) within oil and gas units; 23 (C) within participating areas and/or non-unitized producing acreage. 24 * Sec. 107. DNR - Division of Mining, Land, and Water. (a) The mission of the 25 Division of Mining, Land, and Water is to encourage the use and development of Alaska's 26 land, mineral, and water resources. 27 (b) The legislature intends to measure the success of the division in achieving its 28 mission by considering the 29 (1) number of leases and permits issued for public and private use of state 30 land; 31 (2) number of private-sector jobs in mining compared to the prior fiscal year;

01 (3) number of acres of land conveyed to municipalities compared to total 02 municipal entitlement; 03 (4) percentage change in the number of acres of land sold and the revenue 04 generated from land sales and leases; 05 (5) number of water right files processed as compared to the number of water 06 rights applied for; 07 (6) percentage change in the number of periodic dam safety inspections; 08 (7) number and change in the number of active placer, lode, and coal mines 09 permitted and the number of mining locations staked and processed. 10 * Sec. 108. DNR - Division of Geological and Geophysical Surveys. (a) The mission of 11 the Division of Geological and Geophysical Surveys is to determine the 12 (1) potential of Alaska land for production of metals, minerals, fuels, and 13 geothermal resources; 14 (2) locations and supplies of groundwater and construction material; and 15 (3) potential hazards to buildings, roads, bridges, and other installations and 16 structures. 17 (b) The legislature intends to measure the success of the division in achieving its 18 mission by considering the 19 (1) total value of Alaska's mineral industry; 20 (2) total state revenue generated by Alaska's mineral industry; 21 (3) number of acres of ground under private-sector exploration; 22 (4) number of the square miles included in completed geophysical/geological 23 mineral surveys of at least 1,000 square miles of Alaska land; 24 (5) number of users requesting information on the geology of Alaska from the 25 Division of Geological and Geophysical Surveys web site; 26 (6) number of responses made by the division to requests for information or 27 assistance relating to engineering geology or hazards in the state. 28 * Sec. 109. DNR - Division of Parks and Outdoor Recreation. (a) The mission of the 29 Division of Parks and Outdoor Recreation is to 30 (1) provide outdoor recreation opportunities; 31 (2) conserve, interpret, and preserve natural, cultural, and historic resources

01 and services; and 02 (3) encourage the development of local park and recreational facilities and 03 programs. 04 (b) The legislature intends to measure the success of the division in achieving its 05 mission by considering the 06 (1) percentage of park facilities open; 07 (2) number of visits by site and type of visit; 08 (3) percentage of newly identified historic properties entered on the statewide 09 inventory; 10 (4) amount of dollars generated from sources other than the state government 11 for trail maintenance and site development; 12 (5) level of deferred maintenance in state parks; 13 (6) annual dollars applied to deferred maintenance in state parks. 14 * Sec. 110. DNR - Division of Agriculture. (a) The mission of the Division of 15 Agriculture is to promote and encourage the development of an agricultural industry in the 16 state. 17 (b) The legislature intends to measure the success of the division in achieving its 18 mission by considering the 19 (1) loan to equity ratio in the Agricultural Revolving Loan Fund; 20 (2) number of improved crop accessions produced by the plant material center 21 and grown in the state; 22 (3) percentage change in agricultural acreage compared to the prior fiscal 23 year; 24 (4) monetary value of agricultural products grown in the state that are sold 25 domestically or exported. 26 Article 12. Department of Public Safety. 27 * Sec. 111. Department of Public Safety. The mission of the Department of Public Safety 28 is to ensure public safety and enforce fish and wildlife laws. 29 * Sec. 112. DPS - Division of Fish and Wildlife Protection. (a) The mission of the 30 Division of Fish and Wildlife Protection is to protect the state's fish and game resources. 31 (b) The legislature intends to measure the success of the division in achieving its

01 mission by considering the number of 02 (1) sport fishing violations to contacts made by the division; and 03 (2) hunter violations to contacts. 04 * Sec. 113. DPS - Division of Fire Prevention. (a) The mission of the Division of Fire 05 Prevention is to prevent the loss of life and property from fire and explosion. 06 (b) The legislature intends to measure the success of the division in achieving its 07 mission by considering the 08 (1) number of vehicular and fixed or mobile structure fires; 09 (2) severity of damage caused by vehicular, and by fixed or mobile structure 10 fires; 11 (3) fire deaths related to vehicular and fixed or mobile structure fires. 12 * Sec. 114. DPS - Division of Alaska State Troopers. (a) The mission of the Division of 13 Alaska State Troopers is to preserve the public peace and to protect life and property. 14 (b) The legislature intends to measure the success of the division in achieving its 15 mission by considering the number of 16 (1) homicides and the percent solved per year; 17 (2) sexual assaults and the percent solved per year; 18 (3) burglaries and the percent solved per year. 19 * Sec. 115. DPS - Alaska Police Standards Council. (a) The mission of the Alaska 20 Police Standards Council is to establish professional training and hiring standards for law 21 enforcement officers in the state. 22 (b) The legislature intends to measure the success of the council in achieving its 23 mission by considering the 24 (1) number of complaints received and acted upon; 25 (2) number of training classes held and percent of officers in the state 26 receiving advanced training; 27 (3) number of academies held and the number of new officers trained. 28 * Sec. 116. DPS - Violent Crimes Compensation Board. (a) The mission of the Violent 29 Crimes Compensation Board is to mitigate the effects of having been victimized. 30 (b) The legislature intends to measure the success of the division in achieving its 31 mission by considering the

01 (1) average time from receipt of a claim to the board's final determination; 02 (2) percentage of administrative costs/claim and payout; 03 (3) percentage change from year to year of costs/claims. 04 * Sec. 117. DPS - Council on Domestic Violence and Sexual Assault. (a) The mission 05 of the Council on Domestic Violence and Sexual Assault is to reduce the causes and incidence 06 and to alleviate the effects of domestic violence and sexual assault. 07 (b) The legislature intends to measure the success of the council in achieving its 08 mission by considering the 09 (1) percentage of continuing clients; 10 (2) percentage of the council's budget spent on prevention and educational 11 services and the number of prevention and educational services provided; 12 (3) cost of shelter per night; 13 (4) incidence of reported domestic violence and sexual assault cases; 14 (5) number of homicides from domestic violence and sexual assault. 15 * Sec. 118. DPS - Office of the Commissioner. (a) The mission of the Office of the 16 Commissioner is to provide support and policy direction to divisions within the department. 17 (b) The legislature intends to measure the success of the office in achieving its 18 mission by considering the 19 (1) percentage of divisions that meet assigned performance measures; 20 (2) average time taken to respond to complaints and questions that have been 21 elevated to the commissioner's office. 22 * Sec. 119. DPS - Public Safety Academy. (a) The mission of the Public Safety 23 Academy is to train law enforcement officers. 24 (b) The legislature intends to measure the success of the academy in achieving its 25 mission by considering the 26 (1) cost per officer trained; 27 (2) graduation rate; 28 (3) percentage of officers who remain employed as law enforcement officers 29 one year after graduating. 30 * Sec. 120. DPS - Division of Administrative Services. (a) The mission of the Division 31 of Administrative Services is to provide support services to departmental programs.

01 (b) The legislature intends to measure the success of the division in achieving its 02 mission by considering the 03 (1) personnel cost of administrative services compared to the total personnel 04 costs for the department; 05 (2) number of department employee grievances as compared to the total 06 number of grievances for all state departments. 07 * Sec. 121. DPS - Scientific Crime Detection Laboratory. (a) The mission of the 08 Scientific Crime Detection Laboratory is to provide forensic science services to law 09 enforcement agencies. 10 (b) The legislature intends to measure the success of the laboratory in achieving its 11 mission by considering the 12 (1) average time from receipt of a case to issuance of a report; 13 (2) number of reports issued within 60 days after receipt of a case compared to 14 the total number of reports issued; 15 (3) average cost of case. 16 Article 13. Department of Revenue. 17 * Sec. 122. Department of Revenue. The mission of the Department of Revenue is to 18 collect and invest funds for public purposes. 19 * Sec. 123. DRev - Child Support Enforcement Division. (a) The mission of the Child 20 Support Enforcement Division is to ensure that children receive the child support due them. 21 (b) The legislature intends to measure the success of the Child Support Enforcement 22 Division in achieving its mission by considering each of the following measures as compared 23 to the previous five years: 24 (1) the total operating budget of the division as compared to the total amount 25 of collections; 26 (2) the percentage of current child support collected; 27 (3) the number of child support administrative orders and order modifications 28 that are appealed compared to the total number of new administrative orders and 29 modifications issued during the year; 30 (4) the number of cases where adjustment is overdue by 30 days or more; 31 (5) the percentage of cases in which there are child support orders;

01 (6) the number of cases with arrearages that have collections as compared to 02 the total number of cases with arrearages. 03 * Sec. 124. DRev - Alaska Municipal Bond Bank Authority. (a) The mission of the 04 Alaska Municipal Bond Bank Authority is to provide municipalities with financing options 05 for capital projects. 06 (b) The legislature intends to measure the success of the authority in achieving its 07 mission by considering each of the following measures as compared to the previous five 08 years: 09 (1) the number of applications made to the authority; 10 (2) the number of successful applications. 11 * Sec. 125. DRev - Alaska Permanent Fund Corporation. (a) The mission of the 12 Alaska Permanent Fund Corporation is to maximize the value of the permanent fund for the 13 benefit of all generations of Alaskans through prudent long-term investment. 14 (b) The legislature intends to measure the success of the corporation in achieving its 15 mission by considering each of the following measures as compared to the previous five 16 years: 17 (1) the inflation-adjusted rate of return over time; 18 (2) the inflation-adjusted rate of return over time compared to funds with 19 similar goals and asset allocation structures; 20 (3) the cost to manage the fund as compared to the management costs of funds 21 with similar goals and asset allocation structures; 22 (4) the income at the end of each fiscal year available to benefit Alaskans. 23 * Sec. 126. DRev - Alaska Housing Finance Corporation. (a) The mission of the Alaska 24 Housing Finance Corporation is to provide access to housing and an annual monetary transfer 25 to the state. 26 (b) The legislature intends to measure the success of the corporation in achieving its 27 mission by considering each of the following measures as compared to the previous five 28 years: 29 (1) the number of Alaskans who own their own homes; 30 (2) the number of Alaskans living in housing provided or financed in whole or 31 in part by the corporation;

01 (3) the amount of money transferred to the state under AS 18.56.089. 02 * Sec. 127. DRev - Treasury Division. (a) The mission of the Treasury Division is to 03 manage the state's funds consistent with prudent investment guidelines and Governmental 04 Accounting Standards Board rules. 05 (b) The legislature intends to measure the success of the division in achieving its 06 mission by considering each of the following measures as compared to the previous five 07 years: 08 (1) the investment returns against performance benchmarks; 09 (2) the administrative costs per dollar of investment. 10 * Sec. 128. DRev - State Pension Investment Board. (a) The mission of the State 11 Pension Investment Board is to manage state pension funds. 12 (b) The legislature intends to measure the success of the board in achieving its 13 mission by considering each of the following measures as compared to the previous five 14 years: 15 (1) the investment returns expressed in terms of most recent five-year and one- 16 year averages measured against performance benchmarks; 17 (2) the administrative costs per dollar of investment. 18 * Sec. 129. DRev - Tax Division. (a) The mission of the Tax Division is to collect taxes 19 consistent with statute. 20 (b) The legislature intends to measure the success of the division in achieving its 21 mission by considering each of the following measures as compared to the previous five 22 years: 23 (1) the division budget as compared to the total amount collected by the 24 division; 25 (2) the percentage of taxes collected as compared to the percentage of taxes 26 due; 27 (3) the time expended compared to the time budgeted and the average time 28 taken to complete audits; 29 (4) the amount of assessments disallowed on appeal as compared to the 30 amount of assessments claimed. 31 * Sec. 130. DRev - Office of the Commissioner. (a) The mission of the Office of the

01 Commissioner is to provide support and policy direction to the divisions in the department. 02 (b) The legislature intends to measure the success of the office in achieving its 03 mission by considering each of the following measures as compared to the previous five 04 years: 05 (1) the percentage of divisions that meet assigned performance measures; 06 (2) the number of child support and permanent fund dividend formal appeals 07 in inventory at the formal hearing section at the end of each fiscal quarter; 08 (3) the number of child support and permanent fund dividend formal hearing 09 decisions appealed to the superior court. 10 * Sec. 131. DRev - Division of Administrative Services. (a) The mission of the Division 11 of Administrative Services is to provide support services for departmental programs. 12 (b) The legislature intends to measure the success of the division in achieving its 13 mission by considering each of the following measures as compared to the previous five 14 years: 15 (1) the cost of administrative services as compared to the total personnel costs 16 for the department; 17 (2) the number of audit exceptions resolved for the department. 18 * Sec. 132. DRev - Permanent Fund Dividend Division. (a) The mission of the 19 Permanent Fund Dividend Division is to administer the permanent fund dividend program. 20 (b) The legislature intends to measure the success of the division in achieving its 21 mission by considering each of the following measures as compared to the previous five 22 years: 23 (1) the percentage of dividend payments sent out on time to eligible 24 applicants; 25 (2) the number of application denials upheld on appeal; 26 (3) the cost to administer the program compared to the number of applications 27 processed. 28 * Sec. 133. DRev - Alaska Mental Health Trust Authority. (a) The mission of the 29 Alaska Mental Health Trust Authority is to ensure access to comprehensive and integrated 30 mental health programs. 31 (b) The legislature intends to measure the success of the authority in achieving its

01 mission by considering each of the following measures as compared to the previous five 02 years: 03 (1) the amount of revenue from land and cash; 04 (2) the percentage of trust income disbursed for mental health programs; 05 (3) the number of partners and the amount of money from mental health trust 06 programs received from funding partners. 07 Article 14. Department of Transportation and Public Facilities. 08 * Sec. 134. Department of Transportation and Public Facilities. The mission of the 09 Department of Transportation and Public Facilities is to develop, operate, maintain, and 10 manage facilities, vehicles, and transportation modes. 11 * Sec. 135. DOT/PF - Office of the Commissioner. (a) The mission of the Office of the 12 Commissioner is to provide support and policy direction to the divisions within the 13 department. 14 (b) The legislature intends to measure the success of the office in achieving its 15 mission by considering the percentage of 16 (1) state national highway system lane miles of road that meet standards of the 17 American Association of State Highway Transportation Officials; 18 (2) requested engineering firm audits and desk reviews completed in the 19 previous fiscal year; 20 (3) required compliance reviews for responsiveness to disadvantaged business 21 enterprise and on-the-job training contract requirements completed; 22 (4) the average time taken to respond to complaints and questions that have 23 been elevated to the commissioner's office. 24 * Sec. 136. DOT/PF - Division of Administrative Services. (a) The mission of the 25 Division of Administrative Services is to support the department's operations with 26 administrative support and information technology. 27 (b) The legislature intends to measure the success of the division in achieving its 28 mission by considering 29 (1) whether the average time for payment to vendors is 29 days or less; 30 (2) how long it takes the division to process a purchase request before the 31 order is placed;

01 (3) the percentage of protests and claims appealed to the commissioner that 02 courts overturned during the fiscal year; 03 (4) the percentage reduction in payroll calculation errors. 04 * Sec. 137. DOT/PF - Division of Statewide Planning. (a) The mission of the Division 05 of Statewide Planning is to optimize state and federal investment in transportation projects. 06 (b) The legislature intends to measure the success of the division in achieving its 07 mission by considering the 08 (1) percentage of the projects, by region, mode, and/or components, completed 09 within 15 percent of the budget figure first shown in the STIP, AIP, and other capital budget 10 documents; 11 (2) percentage of required federal planning, programming, and data collection 12 completed and accepted by the United States Department of Transportation on a federal fiscal 13 year basis; 14 (3) rate of seat belt use by drivers and passengers in non-commercial motor 15 vehicles. 16 * Sec. 138. DOT/PF - Division of Statewide Design and Engineering Services. (a) The 17 mission of the Division of Statewide Design and Engineering Services is to develop projects 18 that improve Alaska's transportation and public facilities infrastructure. 19 (b) The legislature intends to measure the success of the division in achieving its 20 mission by considering the 21 (1) percentage of federal highway funds obligated in the previous federal 22 fiscal year; 23 (2) percentage of projects in the capital budget that have been bid in the year 24 programmed; 25 (3) percentage of total project costs spent on project development by the 26 department and by private contractors performing design and engineering services; 27 (4) percentage difference between final project estimates and construction 28 bids; 29 (5) ratio of new projects bid to completed projects closed out during the fiscal 30 year, reported by region; 31 (6) percentage of the design and engineering work of the division that was

01 performed by private contractors; 02 (7) change in the number of intersections with signals having a level of service 03 rating of E or F over a three-year period. 04 * Sec. 139. DOT/PF - Division of Construction and CIP Support. (a) The mission of 05 the Division of Construction and CIP Support is to administer state construction projects. 06 (b) The legislature intends to measure the success of the division in achieving its 07 mission by considering the percentage of the total construction costs that were spent on 08 (1) contract administration; 09 (2) change orders. 10 * Sec. 140. DOT/PF - Public facilities. (a) The mission of the department with respect to 11 public facilities is to manage, operate, and maintain state public facilities. 12 (b) The legislature intends to measure the success of the department in achieving its 13 mission with respect to public facilities by considering 14 (1) whether the net value of facilities deferred maintenance increases or 15 decreases annually; 16 (2) the percentage of facility mechanical systems that pass safety inspections 17 each year; 18 (3) the percentage of rural airport leases that are renewed or newly leased at 19 fair market value during the fiscal year; 20 (4) the transfer of state-owned ports and harbors to local control. 21 * Sec. 141. DOT/PF - Equipment fleet. (a) The mission of the department with respect to 22 the equipment fleet is to allocate, maintain, and manage state-owned vehicles, equipment, and 23 attachments for safe and appropriate use. 24 (b) The legislature intends to measure the success of the department in achieving its 25 mission with respect to the equipment fleet by considering 26 (1) whether 85 percent of the fleet wet rentals are returned to the division as 27 scheduled for preventive maintenance on or before June 30 of the fiscal year; 28 (2) the average down time for light duty, actively used equipment in urban 29 areas; 30 (3) the number of locations of the state equipment fleet whose rates are equal 31 to or less than the rental rates published in industry guide books.

01 * Sec. 142. DOT/PF - Division of Measurement Standards and Commercial Vehicle 02 Enforcement. (a) The mission of the Division of Measurement Standards and Commercial 03 Vehicle Enforcement is to protect the traveling public, preserve the state's transportation 04 infrastructure, and protect consumers' interests in weight and measurement transactions. 05 (b) The legislature intends to measure the success of the division in achieving its 06 mission by considering 07 (1) safety inspections per full-time-equivalent employee of the division; 08 (2) weighing and measuring device inspections conducted per full-time- 09 equivalent employee of the division. 10 * Sec. 143. DOT/PF - Highway maintenance and operations. (a) The mission of the 11 department with respect to highway maintenance and operations is to maintain, protect, and 12 control the state's highway system. 13 (b) The legislature intends to measure the success of the department in achieving its 14 mission with respect to highway maintenance and operations by considering 15 (1) the number of miles of gravel roads that are surfaced with chip seal, hot 16 mix, or high float asphalt for the first time, reported regionally; 17 (2) the percentage of highway and airport lane miles per full-time-equivalent 18 employee compared to the average of member states of the Western Association of State 19 Highway and Transportation Officials; 20 (3) the number of miles of road maintenance for which responsibility is 21 transferred to local governments; 22 (4) whether the department fully implements the maintenance management 23 system statewide by November 30, 2004. 24 * Sec. 144. DOT/PF - Aviation. (a) The mission of the department with respect to 25 aviation is to improve, maintain, and operate state and international airports. 26 (b) The legislature intends to measure the success of the department in achieving its 27 mission with respect to aviation by considering 28 (1) the percentage of applicable rural airports that maintain the pavement 29 condition index (PCI) at 70 for runways and 60 for taxiways and aprons; 30 (2) the percentage of private maintenance contracts at noncertified airports 31 compared to the total number of noncertified airports;

01 (3) the percentage of federally certified airports receiving 100 percent pass 02 level of annual federal airport certification inspections for response and safety standards set 03 out in federal aviation regulations; 04 (4) the percentage of change in cargo landings at certified maximum gross 05 take-off weight at the international airports during the last three years; 06 (5) the percentage of airports that have a Federal Aviation Administration 07 approved airport layout plan. 08 * Sec. 145. DOT/PF - Marine Highway System. (a) The mission of the Alaska Marine 09 Highway System is to assist in meeting the transportation needs of the traveling public and the 10 communities served by the system while prioritizing and maximizing access to service by 11 Alaska residents. 12 (b) The legislature intends to measure the success of the system in achieving its 13 mission by considering the 14 (1) percentage of times that vessels depart on time; 15 (2) revenue per rider mile divided by the operational costs per rider mile, 16 calculated including and excluding fuel cost; 17 (3) total ridership, including passengers and vehicles, compared to the five- 18 year ridership average; 19 (4) average onboard revenue per passenger, including cabin occupancy, food, 20 beverage, and other sources of revenue; 21 (5) percentage of persons served who are satisfied customers; 22 (6) change in the percentage of ridership by Alaska residents. 23 Article 15. University of Alaska. 24 * Sec. 146. University of Alaska. (a) The mission of the University of Alaska is to 25 respond to the educational needs of all Alaskans and to enhance Alaska's economy by 26 fostering and promoting 27 (1) a high quality postsecondary educational system; 28 (2) appropriate vocational education development and training; 29 (3) advancement and extension of knowledge, learning, and culture; and 30 (4) the application of new knowledge and emerging technologies to meet the 31 needs of the state.

01 (b) The legislature intends to measure the success of the University of Alaska in 02 achieving its mission by considering the 03 (1) number and percentage of total Alaska high school graduates who 04 (A) attend the university; 05 (B) attend the university as Alaska Scholars; and 06 (C) attended the university, received a baccalaureate degree, and stay 07 in Alaska one year, five years, and 10 years after graduation from the university; 08 (2) percentage of students graduating with degrees in teacher education, health 09 careers, process technology, transportation and logistics, information technology, and other 10 high demand job areas; 11 (3) number of University of Alaska graduates, by community of origin and by 12 community of current employment, who are new 13 (A) teachers; 14 (B) principals; 15 (C) superintendents; 16 (4) number and percentage of total credit hours and courses offered by 17 distance delivery; 18 (5) cost per credit hour delivered by distance delivery; 19 (6) pre-training wage as compared to the post-training wage for vocational 20 education completers and program graduates; 21 (7) amount of research grants in arctic biology, climate change, resource 22 development, fisheries and ocean science, logistics, geosciences, and atmospheric sciences; 23 (8) number of graduate students whose education is funded by research grants; 24 (9) occurrences of applied research benefiting the state's economy; 25 (10) quality of research as measured by annual citation and significant 26 publications in referred journals; 27 (11) graduation and retention rate of full-time-equivalent students in degree 28 programs; 29 (12) comparative scores of students who take professional examinations. 30 Article 16. Alaska Court System. 31 * Sec. 147. Alaska Court System. (a) The mission of the Alaska Court System is to

01 provide an accessible and impartial forum for the just resolution of all cases that come before 02 it, and to decide the cases in accordance with the law, expeditiously and with integrity. 03 (b) The legislature intends to measure the success of the Alaska Court System in 04 achieving its mission by considering the 05 (1) change in the percentage of the total number of District Court criminal 06 cases affirmed on appeal compared to the previous fiscal year; 07 (2) change in the percentage of the total number of Superior Court criminal 08 cases affirmed on appeal compared to the previous fiscal year; 09 (3) change in the percentage of the total number of Alaska Supreme Court 10 cases appealed to a higher court affirmed on appeal compared to the previous fiscal year; 11 (4) percentage of felony criminal cases dismissed for failure to prosecute 12 within the time limits of the speedy trial rule; 13 (5) change in the percentage of offenders convicted in the Anchorage and 14 Bethel driving while intoxicated courts who have not had another alcohol-related offense 15 compared to the previous fiscal year; 16 (6) change in the percentage of offenders convicted in the Anchorage felony 17 drug court who have not had another illegal substance- or alcohol-related offense compared to 18 the previous fiscal year; 19 (7) change in the percentage of mentally disabled offenders assisted by the 20 Coordinated Resources Project who have not committed another crime since being assisted 21 compared to the previous fiscal year; 22 (8) change in the percentage of offenders convicted in the Anchorage and 23 Juneau Wellness Courts who have not had another alcohol-related offense. 24 Article 17. Miscellaneous Provisions. 25 * Sec. 148. Immunity from Suit. The state and its agents and employees are immune from 26 suit that is based upon accomplishing or failing to accomplish a mission statement or 27 performance measure contained in this Act. 28 * Sec. 149. This Act takes effect July 1, 2003.
