00 CS FOR HOUSE BILL NO. 259(EDU) 01 "An Act relating to school transportation; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 14.09.010 is repealed and reenacted to read: 04 Sec. 14.09.010. Transportation of pupils. (a) A school district that provides 05 student transportation services is eligible to receive funding for operating the student 06 transportation system. Subject to appropriation, the amount of funding provided by 07 the state under this section is the lesser of the amount determined by multiplying the 08 amount of the school district's ADM less the ADM for the district's correspondence 09 programs during the current fiscal year 10 (1) by a per student allocation computed by dividing the amount 11 received by the school district under this section during fiscal year 2003 by the school 12 district's ADM less the ADM for the district's correspondence programs during fiscal 13 year 2003; or 14 (2) by $1,200 per student. 15 (b) In this section,

01 (1) "ADM" has the meaning given in AS 14.17.990; 02 (2) "district's ADM" means the sum of the ADMs in the district. 03 * Sec. 2. AS 14.09.020 is amended to read: 04 Sec. 14.09.020. Transportation for nonpublic school students. In those 05 places in the state where [THE DEPARTMENT OR] a school district provides 06 transportation for children attending public schools, the district [DEPARTMENT] 07 also shall provide transportation for children who, in compliance with the provisions 08 of AS 14.30, attend nonpublic schools that are administered in compliance with state 09 law where the children, in order to reach the nonpublic schools, must travel distances 10 comparable to, and over routes the same as, the distances and routes over which the 11 children attending public schools are transported. The district [COMMISSIONER] 12 shall administer this nonpublic school student transportation program, integrating it 13 into existing systems as much as feasible [, AND THE COST OF THE PROGRAM 14 SHALL BE PAID FROM FUNDS APPROPRIATED FOR THAT PURPOSE BY 15 THE LEGISLATURE]. 16 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 17 read: 18 COST ADJUSTMENT. Adjustment to the amount of money set per student in this 19 Act shall be done on an individual district basis, based on cost increases or decreases. 20 * Sec. 4. This Act takes effect July 1, 2004.
