00 HOUSE BILL NO. 251 01 "An Act exempting certain foreign pleasure craft from the mandatory pilotage 02 requirement." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.62.180 is amended to read: 05 Sec. 08.62.180. Exemptions. This chapter does not apply to 06 (1) vessels subject to federal pilot requirements under 46 U.S.C. 8502 07 except as provided in AS 08.62.185; 08 (2) fishing vessels, including fish processing and fish tender vessels, 09 registered in the United States or in British Columbia, Canada; 10 (3) vessels propelled by machinery and not more than 65 feet in length 11 over deck, except tugboats and towboats propelled by steam; 12 (4) vessels of United States registry of less than 300 gross tons and 13 towboats of United States registry and vessels owned by the State of Alaska, engaged 14 exclusively

01 (A) on the rivers of Alaska; or 02 (B) in the coastwise trade on the west or north coast of the 03 United States including Alaska and Hawaii, and including British Columbia, 04 Yukon Territory, and Northwest Territories, Canada; 05 (5) vessels of Canada, built in Canada and manned by Canadian 06 citizens, engaged in frequent trade between 07 (A) British Columbia and Southeastern Alaska south of 58 08 degrees, 10 minutes North latitude, if reciprocal exemptions are granted by 09 Canada to vessels owned by the State of Alaska and those of United States 10 registry; or 11 (B) northern Alaska north of 68 degrees, 7 minutes North 12 latitude and Yukon Territory or Northwest Territories; 13 (6) pleasure craft of United States registry; [AND] 14 (7) pleasure craft of foreign registry of less than 300 gross tons as 15 measured under 46 C.F.R. 69.51 - 69.75; and 16 (8) pleasure craft of foreign registry of less than 200 feet in length 17 overall that are issued an exemption from this chapter under (b) of this section. 18 * Sec. 2. AS 08.62.180 is amended by adding a new subsection to read: 19 (b) Upon written application by the owner or an agent of the owner of the 20 pleasure craft, the board may issue an exemption from this chapter to a pleasure craft 21 of foreign registry that is not more than 200 feet in length overall. The application 22 must contain the name, address, and telephone number of the applicant; the name, 23 address, and telephone number of the owner of the vessel; a general description of the 24 vessel, including nationality, home port, hull number, length, displacement, and 25 general condition; the purpose of the visit to the state; the names and addresses of the 26 master, crew, and passengers on the vessel; a description of the experience of the 27 master and crew in the water of the state; the names of the crew members who speak 28 English; the type and quantity of fuel and other hazardous substances carried on the 29 vessel; a description of the communications and navigation equipment carried on the 30 vessel; and a description of propulsion, communications, or navigation equipment on 31 the vessel that is not operational.
