01 Relating to the authority of the Department of Natural Resources to issue citations for certain                         
02 skiing violations; relating to establishing a bail schedule for certain skiing violations and to                        
03 procedures for issuing a citation for a skiing violation.

05    * Section 1.  AS 05.45.100(h) is amended to read:                                                                  
06            (h)  A person who violates a provision of (c) or (g) of this section is guilty of a                          
07       violation as defined in AS 11.81.900.  The commissioner of natural resources, a                                   
08       person designated by the ski area operator who is authorized by the commissioner, or                              
09       an employee of the Department of Natural Resources authorized by the commissioner                                 
10       may issue a citation in accordance with the provisions of AS 41.21.960 to a person                                
11       who violates (c) or (g) of this section within a ski area [OVER WHICH THE STATE                                   
12       HAS JURISDICTION].                                                                                                
13    * Sec. 2.  AS 05.45.100 is amended by adding a new subsection to read:                                             
14            (i)  The supreme court shall establish by rule or order a schedule of bail                                   

01       amounts that may be forfeited without a court appearance for a violation of (c) or (g)                            
02       of this section.                                                                                                  
03    * Sec. 3.  AS 12.25.190(c) is amended to read:                                                                     
04            (c)  The person cited for the crime shall give a written promise to appear in                                
05       court by signing at least one copy of the written citation prepared by the peace officer,                         
06       and the officer shall deliver a copy of the citation to the person.  The written promise                          
07       requirement of this subsection does not apply to boating citations for which a bail                               
08       schedule has been established under AS 05.25.090(b), motor vehicle and traffic                                    
09       citations for which a bail or fine schedule has been established under AS 28.05.151,                              
10       fish and game citations for which a bail schedule has been established under                                      
11       AS 16.05.165, citations issued under AS 04.21.065, citations for skiing violations                            
12       issued under AS 05.45.100, citations issued under AS 18.35.341, citations issued in                           
13       state park and recreational facilities under AS 41.21.960, or littering citations issued                          
14       under AS 46.06.080.
