01 "An Act relating to prohibiting the use of cellular telephones when operating a motor                                   
02 vehicle; and providing for an effective date."                                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 28.35 is amended by adding a new section to read:                                               
05            Sec. 28.35.165.  Prohibited use of cellular telephone.  (a)  A driver of a                               
06       motor vehicle may not use a cellular telephone when operating a motor vehicle on a                                
07       highway or vehicular way or area unless the cellular telephone is operated as a hands-                            
08       free telephone.                                                                                                   
09            (b)  A person who violates this section is guilty of an infraction and may be                                
10       punished as provided under AS 28.40.050.                                                                          
11    * Sec. 2.  This Act takes effect July 1, 2003.
