01 "An Act permitting grants to certain regulated public utilities for water quality                                       
02 enhancement projects and water, wastewater, and solid waste systems."                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 46.03.030(b) is amended to read:                                                                  
05            (b)  The department may grant to a municipality or a public utility eligible                             
06       under (i) of this section, as funds are available, a grant for any of the following:                          
07                 (1)  a water quality enhancement project;                                                               
08                 (2)  a public water supply, treatment, or distribution system;                                          
09                 (3)  a wastewater collection, treatment, or discharge system;                                           
10                 (4)  a solid waste processing, disposal, or resource recovery system.                                   
11    * Sec. 2.  AS 46.03.030 is amended by adding a new subsection to read:                                             
12            (i)  A public utility is eligible to apply for a grant under this section if the                             
13       public utility's rates are subject to regulation by the Regulatory Commission of Alaska                           
14       under AS 42.05.  A grant under this section to a public utility for a project funded by                           

01       an appropriation made by the legislature may not exceed                                                           
02                 (1)  85 percent of the eligible costs for a public utility with a population                            
03       of 1,000 persons or less within its service area;                                                                 
04                 (2)  70 percent of the eligible costs for a public utility with a population                            
05       of 1,001 to 5,000 persons within its service area; and                                                            
06                 (3)  50 percent of the eligible costs for a public utility with a population                            
07       greater than 5,000 persons within its service area; however, if a public utility with a                           
08       population greater than 5,000 persons seeks a grant for a project that relates to a solid                         
09       waste processing or disposal system that incorporates resource recovery, the                                      
10       department may provide a grant for up to 60 percent of the eligible costs of the project.
