00 HOUSE CS FOR CS FOR SENATE BILL NO. 274(L&C) 01 "An Act relating to issuance of a locum tenens permit for a physician or osteopath; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.64.275(a) is amended to read: 05 (a) A member of the board or its executive secretary may grant a temporary 06 permit to a physician or osteopath for the purpose of 07 (1) substituting for another physician or osteopath licensed in this 08 state; 09 (2) being temporarily employed by a physician or osteopath 10 licensed in this state while that physician or osteopath evaluates the permittee for 11 permanent employment; or 12 (3) being temporarily employed by a hospital or community 13 mental health center while the facility attempts to fill a vacant permanent 14 physician or osteopath staff position with a physician or osteopath licensed in this

01 state [. THE PERMIT IS VALID FOR 60 CONSECUTIVE DAYS. IF 02 CIRCUMSTANCES WARRANT, AN EXTENSION OF THE PERMIT MAY BE 03 GRANTED BY THE BOARD OR ITS DESIGNEE]. 04 * Sec. 2. AS 08.64.275(e) is amended to read: 05 (e) A permit issued under this section is initially valid for 90 consecutive 06 calendar days. Upon request by a permittee, a permit issued under this section 07 shall be extended for 60 calendar days by the board or its designee if, before the 08 expiration of the initial 90-day permit, the permittee submits to the department a 09 completed application form and the fee required for licensure under this chapter, 10 except that the board may refuse to grant a request for an extension for the same 11 reasons the board may refuse to grant a license under AS 08.64.240. Permits and 12 extensions of permits issued to an individual under this section [TO AN 13 INDIVIDUAL] are not valid for more than 240 calendar days during any consecutive 14 24 months. 15 * Sec. 3. AS 08.64.275 is amended by adding a new subsection to read: 16 (f) Notwithstanding (e) of this section, a permit issued under this section may 17 be extended by the board or its designee for a time period that exceeds the limit 18 established in (e) of this section if the board or its designee determines that the 19 extension is necessary in order to provide essential medical services for the protection 20 of public health and safety and the board has received a 21 (1) clearance report from the National Practitioner Data Bank; 22 (2) physician profile from the American Medical Association or the 23 American Osteopathic Association; 24 (3) clearance report from the United States Drug Enforcement 25 Administration; and 26 (4) completed application form and the fee required for licensure under 27 this chapter. 28 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
