00 SENATE BILL NO. 222 01 "An Act relating to certain motor vehicles that are required to yield to following 02 traffic." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 19.05.030 is amended to read: 05 Sec. 19.05.030. Duties of department. The department has the following 06 duties: 07 (1) direct approved highway planning and construction and 08 maintenance, protection, and control of highways; 09 (2) employ assistants and employees; 10 (3) certify and approve vouchers; 11 (4) provide a program of highway research; 12 (5) prepare a budget; 13 (6) review the annual highway program; 14 (7) develop and implement an avalanche control plan to protect

01 persons who use public highways; 02 (8) place signs along public highways as required by 03 AS 28.35.140(b). 04 * Sec. 2. AS 28.35.140 is amended by adding a new subsection to read: 05 (b) A person operating a motor vehicle on a two-lane roadway shall pull the 06 motor vehicle off the roadway at the first opportunity to pull over safely whenever 07 there is at least 100 feet of visible and unobstructed roadway in front of that motor 08 vehicle and there are five or more motor vehicles immediately following that motor 09 vehicle. The Department of Transportation and Public Facilities shall place a sign that 10 provides notice of the requirements of this subsection at the beginning of each section 11 of public highway that extends for five miles without a passing zone. A person 12 operating a motor vehicle who violates this subsection is guilty of an infraction as 13 described in AS 28.40.050(d) and shall be punished by a fine of at least $200.
