00 SENATE BILL NO. 142 01 "An Act giving notice of and approving a lease-purchase agreement with the City of 02 Seward for the construction of an addition to the Spring Creek Correctional Center for 03 the purpose of providing secure classroom facilities and housing for prisoners 04 committed to the custody of the commissioner of corrections; and setting conditions and 05 limitations on the facility's construction and operation." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 08 to read: 09 FINDINGS AND PURPOSE. (a) The legislature finds that 10 (1) the state and the commissioner of corrections have certain constitutional 11 and statutory duties to attempt to reform and rehabilitate prisoners and to provide educational 12 and other opportunities to improve the opportunity for the eventual successful reintegration of 13 those prisoners into society;

01 (2) the Spring Creek Correctional Center has a successful pilot program that is 02 intended to achieve these goals; 03 (3) school age under AS 14.03.070 extends until a person attains 20 years of 04 age if that person has not completed the 12th grade; and 05 (4) more than 400 inmates statewide are under 21 years of age and could 06 benefit from educational programs. 07 (b) The purpose of this Act is to provide educational opportunities for prisoners 08 committed to the custody of the commissioner of corrections and especially to provide those 09 opportunities to prisoners of school age through the pilot program that has been implemented 10 at Spring Creek Correctional Center. 11 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 12 read: 13 NOTICE AND APPROVAL OF LEASE-PURCHASE AGREEMENT. (a) To 14 provide for the construction of a correctional facility and to provide secure classroom 15 facilities and housing for prisoners transferred to Spring Creek Correctional Facility to use 16 those facilities, the Department of Administration, on behalf of the Department of 17 Corrections, may enter into a lease-purchase agreement with the City of Seward under 18 AS 33.30.031 for the construction of an addition to the Spring Creek Correctional Center that 19 will provide secure classroom facilities and housing for prisoners who are committed to the 20 custody of the commissioner of corrections. The project approval given by this subsection is 21 subject to the following limitations: 22 (1) the total construction and related costs of the addition to the correctional 23 facility may not exceed $15,000,000; 24 (2) the total lease payments for the full term of the agreement may not exceed 25 $28,320,000, and the anticipated annual amount of the rental obligation to be paid by the 26 Department of Corrections under the lease may not exceed $1,621,200; 27 (3) at the end of the term of the lease-purchase agreement, the state shall own 28 the correctional facility; and 29 (4) the addition must be designed and constructed so as to provide secure 30 classroom facilities and housing for prisoners transferred to Spring Creek Correctional Center 31 to use those facilities; not fewer than 150 additional beds shall be constructed.
