00                      HOUSE JOINT RESOLUTION NO. 18                                                                     
01 Proposing amendments to the Constitution of the State of Alaska relating to certain                                     
02 municipal annexations."                                                                                                 
03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  Article X, sec. 12, Constitution of the State of Alaska, is amended to read:                         
05            Section 12.  Boundaries.  (a)  A local boundary commission or board shall be                           
06       established by law in the executive branch of the state government.  The commission                               
07       or board may consider any proposed local government boundary change.  Subject to                              
08       (b) of this section, it [IT] may present proposed changes to the legislature during the                       
09       first ten days of any regular session.  The change shall become effective forty-five                              
10       days after presentation or at the end of the session, whichever is earlier, unless                                
11       disapproved by a resolution concurred in by a majority of the members of each house.                              
12       The commission or board, subject to law, may establish procedures whereby                                         
13       boundaries may be adjusted by local action.                                                                       
14    * Sec. 2.  Article X, sec. 12, Constitution of the State of Alaska, is amended by adding a                         
15 new subsection to read:                                                                                                 
16            (b)  The local boundary commission or board may present to the legislature a                                 

01       proposed annexation of an area to an existing city or borough only if the proposal has                            
02       first been approved by a majority of the voters residing in the area proposed for                                 
03       annexation.  An annexation by local action may occur only if the proposal has first                               
04       been approved by a majority of the voters residing in the area proposed for annexation.                           
05       This subsection does not apply if no voters reside in an area proposed for annexation.                            
06       This subsection applies only if                                                                                   
07                 (1)  the physical size of the area is greater than ten percent of the                                   
08       physical size of the city or borough to which the area is proposed to be annexed; or                              
09                 (2)  the population of the area is more than ten percent of the                                         
10       population of the city or borough to which the area is proposed to be annexed.                                    
11    * Sec. 3.  The amendments proposed by this resolution shall be placed before the voters of                         
12 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the                        
13 State of Alaska, and the election laws of the state.
