00 CS FOR HOUSE BILL NO. 480(STA) 01 "An Act providing that the death of an employee killed because of the employee's job 02 status shall be considered an occupational death for purposes of survivor's pension 03 benefits in the teachers' retirement system and the public employees' retirement 04 system." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 14.25.157 is amended by adding a new subsection to read: 07 (d) If a member's death is caused by an act of assault, assassination, or 08 terrorism directly related to the person's status as a member, whether the act occurs on 09 or off the member's job site, the death shall be considered to have occurred in the 10 performance of and within the scope of the member's duties for purposes of (a)(2) of 11 this section. If the expressed or apparent motive and intent of the perpetrator of the 12 harm inflicted upon the member was due to the performance of the member's job 13 duties or employment as a member, the death shall be considered to be directly related 14 to the member's status as a member. A member's job duties are those performed

01 within the course and scope of the member's employment with an employer. 02 * Sec. 2. AS 39.35.430 is amended by adding a new subsection to read: 03 (g) If an employee's death is caused by an act of assault, assassination, or 04 terrorism directly related to the person's status as an employee, whether the act occurs 05 on or off the employee's job site, the death shall be considered to have occurred in the 06 performance of and within the scope of the employee's duties for purposes of (b)(2) of 07 this section.
