01 "An Act providing for compliance with local planning and zoning ordinances by the                                       
02 Alaska Railroad Corporation."                                                                                           
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 42.40.390 is amended to read:                                                                     
05            Sec. 42.40.390.  Land use rules.  (a)  Subject to (b) of this section, the                               
06       [THE] board may adopt [EXCLUSIVE] rules governing land use by parties having                                      
07       interests in or permits for land owned or managed by the corporation.  The power                                  
08       conferred by this section is exercised for the common health, safety, and welfare of the                          
09       public and, to the extent constitutionally permissible, may not be limited by the terms                       
10       and conditions of leases, contracts, or other transactions.                                                       
11            (b)  The corporation shall comply with local planning and zoning                                         
12       ordinances in the same manner and to the same extent as other landowners.
