00 HOUSE BILL NO. 426 01 "An Act requiring state agencies to provide for electronic submission of forms and 02 relating to annual reports of state agencies." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.99 is amended by adding a new section to read: 05 Sec. 44.99.025. Provision for electronic submission of state forms. (a) A 06 state agency shall provide for the electronic submission of all forms used by the 07 agency, whether the forms are submitted to the agency by other persons or used only 08 within the agency itself. This subsection applies to forms used for applications, 09 requests, permits, or other purposes. 10 (b) The department of administration may exempt a form used by an agency 11 of the executive branch from the requirement of (a) of this section if the department 12 finds that providing for electronic submission of the form would be technically 13 infeasible or fiscally irresponsible. Upon application by an agency in the legislative 14 branch, the Alaska Legislative Council may exempt a form from the requirement of

01 (a) of this section if the council finds that providing for electronic submission of the 02 form would be technically infeasible or fiscally irresponsible. For purposes of this 03 subsection, providing for electronic submission of a form is fiscally irresponsible 04 when the initial cost of setting up the electronic system is greater than the present 05 value of the savings that would result from the electronic submission of the form 06 during the estimated time the system would be used. 07 (c) In this section, "agency" means an administrative office of the legislative 08 branch or a department, board, commission, division, public corporation, or other unit 09 of the executive branch, including the University of Alaska. 10 * Sec. 2. AS 44.99 is amended by adding a new section to read: 11 Sec. 44.99.215. Annual reports. A state agency that prepares an annual 12 report shall make the report accessible electronically on-line. The state agency may 13 not distribute printed copies of the annual report except 14 (1) as required by another provision of law; 15 (2) when a printed copy is specifically requested; or 16 (3) when a printed copy is sold for an amount that is sufficient to cover 17 the per copy cost of producing the report.
