00 HOUSE BILL NO. 341 01 "An Act relating to assault in the fourth degree that is a crime involving domestic 02 violence." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 11.41.230(b) is amended to read: 05 (b) Assault in the fourth degree is a 06 (1) class A misdemeanor; 07 (2) class C felony if 08 (A) the assault is a crime involving domestic violence; and 09 (B) the defendant has been previously convicted two or 10 more times of a crime against a person or a crime involving domestic 11 violence, or a combination of those offenses. 12 * Sec. 2. AS 12.55.135(c) is amended to read: 13 (c) A defendant convicted of assault in the fourth degree that is a 14 misdemeanor crime involving domestic violence committed in violation of the
01 provisions of an order issued or filed under AS 12.30.027 or AS 18.66.100 - 18.66.180 02 and not subject to sentencing under (g) of this section shall be sentenced to a minimum 03 term of imprisonment of 20 days. 04 * Sec. 3. AS 12.55.135(g) is amended to read: 05 (g) A defendant convicted of assault in the fourth degree that is a 06 misdemeanor crime involving domestic violence shall be sentenced to a minimum 07 term of imprisonment of 08 [(1)] 30 days if the defendant has been previously convicted of a crime 09 against a person or a crime involving domestic violence [; 10 (2) 60 DAYS IF THE DEFENDANT HAS BEEN PREVIOUSLY 11 CONVICTED TWO OR MORE TIMES OF A CRIME AGAINST A PERSON OR A 12 CRIME INVOLVING DOMESTIC VIOLENCE, OR A COMBINATION OF 13 THOSE CRIMES].
