00 HOUSE BILL NO. 309 01 "An Act relating to the Interstate Compact on Placement of Children." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 47.70 is amended by adding a new section to read: 04 Sec. 47.70.035. Original documents required. (a) When this state is the 05 sending state and supporting documentation is requested by the receiving state under 06 art. III(c) of the Interstate Compact on the Placement of Children, the Department of 07 Health and Social Services shall supply to the receiving state the original of the 08 documents requested. When this state is intended to be the receiving state, the 09 Department of Health and Social Services may not accept placement of the child 10 unless documentation requested under art. III(c) of the compact is supplied in original 11 form. Oral information, facsimiles, photocopies, and internet communications are not 12 considered to be in original form for purposes of this section. 13 (b) Each agreement under which this state is the sending or receiving state for 14 a particular child must be in writing, and an original of the agreement shall be held in 15 the files of the department for each child sent from or brought into this state under the

01 Interstate Compact on the Placement of Children. 02 * Sec. 2. AS 47.70.040 is amended to read: 03 Sec. 47.70.040. Agreements. The officers and agencies of this state and its 04 subdivisions having authority to place children are empowered to enter into 05 agreements with appropriate officers or agencies of or in other party states under art. 06 V(b) of the Interstate Compact on the Placement of Children. An agreement under 07 this section must be in writing, and an original of the agreement shall be held in 08 the files of the department. 09 * Sec. 3. AS 47.70.070 is amended to read: 10 Sec. 47.70.070. Violations of compact. A person who sends, brings, or 11 causes to be sent or brought into this state from any party state, or from this state into 12 any party state, a person under the age of 19, in violation of the Interstate Compact on 13 the Placement of Children, is guilty of a misdemeanor, and upon conviction is 14 punishable by a definite term of imprisonment of not more than 180 days and a 15 fine of not more than $1,000 for each violation. Each day that a child is in this 16 state or a party state due to a violation of the compact is a separate violation for 17 purposes of this section [$200].
