00 HOUSE BILL NO. 306 01 "An Act authorizing the Department of Community and Economic Development to 02 issue permits to certain agencies to purchase, possess, and use certain drugs for 03 euthanizing domestic animals." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.02 is amended by adding a new section to read: 06 Sec. 08.02.050. Permits for use of drugs to euthanize domestic animals. 07 (a) A qualified agency may apply to the department and obtain a permit that 08 authorizes the purchase, possession, and use of sodium pentobarbital and sodium 09 pentobarbital with lidocaine by the agency for the purpose of euthanizing injured, sick, 10 or abandoned domestic animals in the lawful possession of the agency. To qualify to 11 obtain the permit, the agency shall certify that it will 12 (1) comply with applicable federal laws related to the use of the drugs; 13 and 14 (2) not permit an employee to administer the drugs unless the

01 employee has adequate knowledge of the potential hazards and proper techniques to 02 be used in administering the drugs; evidence of adequate knowledge means that the 03 employee has 04 (A) successfully completed a euthanasia technician certification 05 course approved by the National Animal Control Association, the American 06 Humane Association, or the Humane Society of the United States; the 07 curriculum of the course must include the pharmacology, proper 08 administration, and storage of euthanasia solutions; federal and state laws 09 regulating the storage and accountability of euthanasia solutions; euthanasia 10 technician stress management; and proper disposal of euthanized animals; or 11 (B) provided to the agency a notarized statement from a 12 veterinarian licensed in the state that the employee has been trained by that 13 veterinarian in use, storage, accountability, and proper techniques of 14 administering the drugs for the purpose of performing euthanasia on domestic 15 animals. 16 (b) A permit issued under (a) of this section is valid for two years. 17 (c) The application fee for a permit under this section is $50, and the biennial 18 renewal fee is $50. 19 (d) The department may revoke or suspend a permit if it determines that the 20 agency or an employee of the agency 21 (1) improperly used sodium pentobarbital or sodium pentobarbital with 22 lidocaine; or 23 (2) failed to follow the federal regulations regarding proper storage and 24 handling of the drugs. 25 (e) In this section, "agency" means a municipal or village animal control 26 agency or an entity that has contracted with a municipality or village to perform 27 animal control or animal euthanasia services. 28 * Sec. 2. AS 08.98.120(a) is amended to read: 29 (a) A person may not practice veterinary medicine, surgery, or dentistry unless 30 the person is licensed as a veterinarian under this chapter or has a temporary permit 31 issued under AS 08.98.186, except that a person may perform functions authorized by

01 (1) regulation of the board if the person is licensed as a veterinary 02 technician; or 03 (2) a permit issued under AS 08.02.050 if the person is employed 04 by an agency that has a permit issued under AS 08.02.050.
