00 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 289 am 01 "An Act relating to the effective date of a municipal manager plan that has been 02 adopted and to the effective date of the repeal of a municipal manager plan, and relating 03 to a special election for mayor when municipal manager plans are adopted or repealed." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 29.20.480(a) is amended to read: 06 (a) If a manager plan is approved, the governing body shall, within 60 days, 07 adopt the plan by ordinance or resolution. The manager plan takes effect on the 08 earlier of the following: 09 (1) the day after the last day of the term of the mayor in office on 10 the date the plan is adopted by the governing body; or 11 (2) one year after the date the plan is adopted by the governing 12 body. 13 * Sec. 2. AS 29.20.520 is amended to read: 14 Sec. 29.20.520. Repeal of manager plan. A municipality may repeal a

01 manager plan by following the procedures under AS 29.20.460 - 29.20.480 for 02 adoption of a manager plan, except the question shall be whether the manager plan 03 should be repealed. Within 60 days after certification of the election approving repeal 04 of a manager plan, the governing body shall enact provisions for the reorganization of 05 the municipal executive and administrative functions. The repeal of the manager 06 plan and reorganization provisions take effect on the earlier of the following: 07 (1) the day after the last day of the term of the mayor in office on 08 the date the provisions are enacted; or 09 (2) one year after the date the provisions are enacted. 10 * Sec. 3. AS 29.20 is amended by adding a new section to article 6 to read: 11 Sec. 29.20.530. Special election for mayor. (a) Notwithstanding 12 AS 29.20.230, a municipality may by ordinance provide that, when a manager plan 13 takes effect under AS 29.20.480(a)(2) or when a repeal of a manager plan takes effect 14 under AS 29.20.520(2), the term of office of the incumbent mayor ends on that 15 effective date. An ordinance adopted under this subsection must include procedures 16 for holding a special election for mayor and must establish the term of office of a 17 mayor elected at the special election. 18 (b) This section does not apply in a second class city.
