00 CS FOR HOUSE BILL NO. 212(L&C) 01 "An Act requiring a subcontractor to obtain workers' compensation insurance covering 02 the subcontractor and the subcontractor's employees and establishing responsibility of a 03 contractor for obtaining workers' compensation coverage for the subcontractor and the 04 subcontractor's employees if the subcontractor fails to obtain workers' compensation 05 coverage; and providing for an effective date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 23.30.045(a) is amended to read: 08 (a) An employer is liable for and shall secure [THE] payment [TO 09 EMPLOYEES] of the compensation payable to employees under AS 23.30.041, 10 23.30.050, 23.30.095, 23.30.145, and 23.30.180 - 23.30.215. If the employer is a 11 subcontractor, the subcontractor shall secure payment of the compensation 12 payable to the subcontractor's employees, and the coverage must include 13 securing payment of the compensation payable to the subcontractor. If the
01 subcontractor fails to secure payment of the compensation payable, the contractor 02 is liable for and shall secure the payment of the compensation payable to the 03 subcontractor and to employees of the subcontractor [UNLESS THE 04 SUBCONTRACTOR SECURES THE PAYMENT]. 05 * Sec. 2. This Act takes effect January 1, 2002.
