01 "An Act relating to an employer's liability for providing workers' compensation                                         
02 coverage."                                                                                                              
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 23.30.045(a) is amended to read:                                                                  
05            (a)  An employer is liable for and shall secure [THE] payment [TO                                            
06       EMPLOYEES] of the compensation payable to employees under AS 23.30.041,                                       
07       23.30.050, 23.30.095, 23.30.145, and 23.30.180 - 23.30.215.  If the employer is a                                 
08       subcontractor, the subcontractor shall secure payment of the compensation                                     
09       payable to the subcontractor's employees, and the coverage must include                                       
10       securing payment of the compensation payable to the subcontractor.  If the                                    
11       subcontractor fails to secure payment of the compensation payable, the contractor                             
12       is liable for and shall secure the payment of the compensation payable to the                             
13       subcontractor and to employees of the subcontractor [UNLESS THE                                               
14       SUBCONTRACTOR SECURES THE PAYMENT].
