00 CS FOR HOUSE BILL NO. 152(RLS) 01 "An Act relating to brewpub licenses; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 04 to read: 05 TEMPORARY BREWPUB MANUFACTURING AND SALES LIMITS. 06 Notwithstanding AS 04.11.135(a) and (d), beginning July 1, 2001, and ending June 30, 2002, 07 (1) a holder of a brewpub license may 08 (A) manufacture on premises licensed under the beverage dispensary 09 license not more than 150,000 gallons of beer in a calendar year; 10 (B) sell not more than 75,000 gallons of beer manufactured on 11 premises licensed under the beverage dispensary license for consumption on the 12 licensed premises or other licensed premises of the beverage dispensary licensee that 13 are also licensed as a beverage dispensary; 14 (C) sell beer manufactured on the premises licensed under the 15 beverage dispensary license in quantities of not more than five gallons a day to an

01 individual who is present on the licensed premises; 02 (D) provide a small sample of the brewpub's beer manufactured on the 03 premises free of charge unless prohibited by AS 04.16.030; and 04 (E) sell not more than 75,000 gallons of beer manufactured on the 05 premises licensed under the beverage dispensary license to a person licensed as a 06 wholesaler under AS 04.11.160; and 07 (2) a holder of a brewpub license who, under the provisions of 08 AS 04.11.450(b), formerly held a brewery license and a restaurant or eating place license and 09 who, under the former brewery license, manufactured beer at a location other than the 10 premises licensed under the former restaurant or eating place license may 11 (A) manufacture not more than 150,000 gallons of beer in a calendar 12 year on premises other than the premises licensed under the beverage dispensary 13 license; 14 (B) provide a small sample of the manufactured beer free of charge at 15 the location the beer is manufactured unless prohibited by AS 04.16.030; and 16 (C) sell the beer authorized to be manufactured under this paragraph 17 (i) in a quantity not to exceed 75,000 gallons on the premises 18 licensed under the beverage dispensary license or other licensed premises of 19 the beverage dispensary licensee that are also licensed as a beverage 20 dispensary; 21 (ii) in a quantity not to exceed 75,000 gallons to a wholesaler 22 licensed under AS 04.11.160; and 23 (iii) to an individual who is present on the premises where the 24 beer is manufactured in quantities of not more than five gallons a day. 25 * Sec. 2. This Act takes effect July 1, 2001.
