00 HOUSE BILL NO. 109 01 "An Act relating to failure by an election official to execute the voter's certificate on an 02 absentee ballot or by a person authorized by law to execute the voter's certificate on a 03 questioned ballot." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 15.20.203(b) is amended to read: 06 (b) An absentee ballot may not be counted if 07 (1) the voter has failed to properly execute the certificate; 08 (2) an official or the witnesses authorized by law to attest the voter's 09 certificate fail to execute the certificate, except that an absentee ballot cast in 10 person and accepted by an absentee voting official or election supervisor may be 11 counted despite failure of the absentee voting official or election supervisor to 12 properly sign and date the voter's certificate as attesting official as required 13 under AS 15.20.061(c); 14 (3) the ballot is not attested on or before the date of the election;
01 (4) the ballot, if postmarked, is not postmarked on or before the date of 02 the election; or 03 (5) after the day of election, the ballot was delivered by a means other 04 than mail. 05 * Sec. 2. AS 15.20.207(b) is amended to read: 06 (b) A questioned ballot may not be counted if 07 [(1)] the voter has failed to properly execute the certificate [; OR 08 (2) AN OFFICIAL OR THE WITNESSES AUTHORIZED BY LAW 09 TO ATTEST THE VOTER'S CERTIFICATE FAIL TO EXECUTE THE 10 CERTIFICATE].
