00 HOUSE BILL NO. 25 01 "An Act specifying that failure to provide adequate education, for purposes of finding a 02 child to be a child in need of aid, means failure to be in compliance with compulsory 03 school attendance requirements." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 47.10.014 is amended to read: 06 Sec. 47.10.014. Neglect. For purposes of this chapter, the court may find 07 neglect of a child if the parent, guardian, or custodian fails to provide the child with 08 adequate food, clothing, shelter, education, medical attention, or other care and control 09 necessary for the child's physical and mental health and development, though 10 financially able to do so or offered financial or other reasonable means to do so. For 11 purposes of this section, a parent, guardian, or custodian has failed to provide a 12 child with adequate education only if the court finds, by a preponderance of the 13 evidence, that the parent, guardian, or custodian has knowingly failed to comply 14 with AS 14.30.010.
