SCR 11: Relating to legislative review and disapproval of agreements under the Public Employment Relations Act that exceed net zero cost to the state.

00SENATE CONCURRENT RESOLUTION NO. 11 01 Relating to legislative review and disapproval of agreements under the Public 02 Employment Relations Act that exceed net zero cost to the state. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 WHEREAS it is the right and duty of the legislature to review and approve the 05 monetary terms of any agreement entered into under the authority of the Public Employment 06 Relations Act; and 07 WHEREAS the legislature informed the executive branch through Legislative Resolve 08 34 on May 21, 1997, that the legislature reserved the right to disapprove any agreement that 09 failed to achieve net zero cost to the state and resulted in increased costs in personal services 10 as long as general fund revenues remain below expenditures; and 11 WHEREAS the Department of Administration has entered into agreements during 12 1999 with various labor organizations under the authority of the Public Employment Relations 13 Act, including the following and, possibly, including others: 14 (1) Local 71;

01 (2) Public Safety Employees Association; 02 (3) Inlandboatmen's Union; 03 (4) AVTECTA; 04 (5) Alaska Public Employees Association; 05 (6) International Organization of Masters, Mates, and Pilots; and 06 WHEREAS the Department of Administration has failed to adequately report the terms 07 of these agreements to the legislature for review and approval; 08 BE IT RESOLVED that the Alaska State Legislature requires copies of all agreements 09 executed after June 30, 1998, that modify the terms of collective bargaining agreements, 10 copies of collective bargaining agreements tentatively agreed to in 1999, and copies of all 11 work papers and other analyses of the costs of the agreements; and be it 12 FURTHER RESOLVED that the Alaska State Legislature specifically disapproves 13 the monetary terms of all agreements, including but not limited to employer contributions to 14 health benefits, that the Department of Administration may have entered into during 1999 15 under the authority of the Public Employment Relations Act; and be it 16 FURTHER RESOLVED that the legislature by this action refuses to appropriate any 17 state funds to satisfy the terms of any agreement entered into during 1999 under the authority 18 of the Public Employment Relations Act if the agreement has not been approved by the 19 legislature under AS 23.40.215.
