01 "An Act relating to fees charged for inspections by the Department of                                                   
02 Environmental Conservation; and providing for an effective date."                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 44.46.025 is amended by adding a new subsection to read:                                          
05  (e)  Notwithstanding (a) of this section, the department may not charge a fee                                         
06 for an inspection of a food establishment as part of the permit fee or as part of any                                   
07 other fee related to the establishment.  The department may not charge a fee for an                                     
08 inspection of a food establishment until the inspection takes place.  In this section,                                  
09 "food establishment" means the premises where an activity occurs that is related to the                                 
10 preparation, processing, packaging, storage, transportation, display, sale, service, or                                 
11 salvaging of food for human consumption, except that "food establishment" does not                                      
12 include a private dwelling, including a vessel used solely as a private dwelling, where                                 
13 food is prepared for consumption by family members or nonpaying guests.                                                 
14    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
