AS 19.30.400 is amended by adding a new subsection to read: 10 (e) The Department of Natural Resources shall create and maintain a record 11 on the automated state land records system of rights-of-way that the department 12 identifies as having been acquired under former 43 U.S.C. 932 and that have been 13 either reported to the legislature under (b) of this section or listed in (d) of this section. 14 * Sec. 3. AS 19.30 is amended by adding a new section to read: 15 Sec. 19.30.415. Survey, mapping, and recording requirements for rights-of- 16 way. (a) The state 17 (1) may survey a right-of-way acquired under former 43 U.S.C. 932; 18 and 19 (2) may flag or otherwise mark a right-of-way acquired under former 20 43 U.S.C. 932 to make the route of the right-of-way visually evident. 21 (b) If a right-of-way acquired under former 43 U.S.C. 932 and reported to the 22 legislature under AS 19.30.400(b) or listed in AS 19.30.400(d) is surveyed, the 23 Department of Natural Resources shall, within one year after the survey, record the 24 right-of-way under AS 40.17. 25 (c) Regardless of whether a right-of-way acquired under former 43 U.S.C. 932 26 and reported to the legislature under AS 19.30.400(b) or listed in AS 19.30.400(d) has 27 been surveyed, the Department of Natural Resources shall, within two years after the 28 listing of a right-of-way acquired under former 43 U.S.C. 932 in AS 19.30.400, record 29 the right-of-way under AS 40.17, unless it has been already recorded, if any of the 30 following applies: 31 (1) the route of the right-of-way is shown on a supplemental plat;
01 (2) the route of the right-of-way is sufficiently known to identify all of 02 the specific parcels that the right-of-way encumbers; 03 (3) the route of the right-of-way is sufficiently known to identify all of 04 the specific parcels that the right-of-way may encumber, and each of those parcels is 05 at least 160 acres in size. 06 (d) If the right-of-way satisfies the recording requirements of this section, the 07 department and the recorder may not require the right-of-way to satisfy the formal 08 requisites for recording contained in AS 40.17.030. 09 * Sec. 4. AS 19.30.420(a) is amended to read: 10 (a) Notwithstanding AS 09.50.250 and AS 09.65.070, the state and its political 11 subdivisions are not liable for damages, injury, or death arising from AS 19.30.400 - 12 19.30.420 and the recording of any rights-of-way identified under [IN] AS 19.30.400 13 or acquired under former 43 U.S.C. 932. 14 * Sec. 5. Section 3, ch. 26, SLA 1998 is repealed.
