00SENATE BILL NO. 196 01 "An Act relating to selection of members of the planning commission for a first 02 or second class borough." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 29.40.020(a) is amended to read: 05  (a) Each first and second class borough shall establish a planning commission 06 consisting of five residents unless a greater number is required by ordinance. 07 Commission membership shall be apportioned so that the number of members from 08 home rule and first class cities reflects the proportion of borough population residing 09 in home rule and first class cities located in the borough. Unless an ordinance 10 providing for election of planning commission members is adopted under (c) of 11 this section, a [A] member shall be appointed by the borough mayor [FOR A TERM 12 OF THREE YEARS] subject to confirmation by the assembly, except that a member 13 from a home rule or first class city shall be selected from a list of recommendations 14 submitted by the council. Members serve three-year terms, except that initial

01 members [FIRST APPOINTED] shall draw lots for one-year, two-year, and three- 02 year [ONE, TWO, AND THREE YEAR] terms. Appointments to fill vacancies are for the 03 unexpired term. The compensation and expenses of the planning commission and its staff are 04 paid as directed by the assembly. 05 * Sec. 2. AS 29.40.020 is amended by adding a new subsection to read: 06  (c) Notwithstanding AS 29.20.320(b), a first or second class borough may by 07 ordinance provide for election of planning commission members. Only voters residing 08 in home rule or first class cities within the borough may vote for the members that 09 must be from home rule or first class cities under the apportionment of the planning 10 commission required under (a) of this section. Only voters residing outside of home 11 rule or first class cities may vote for members that must be from the borough area 12 outside of home rule or first class cities. The borough mayor shall fill a vacancy in 13 an elected position by appointment, subject to confirmation by the assembly.
