00SENATE BILL NO. 148 01 "An Act imposing landing fees at state owned and operated airports; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 02.15 is amended by adding a new section to read: 05  Sec. 02.15.085. Airport landing fees. (a) At an airport owned and operated 06 by the state and certificated by the Federal Aviation Administration under 14 C.F.R. 07 Part 139, other than an international airport, a landing fee of 50 cents per 1,000 pounds 08 of certificated maximum gross takeoff weight is imposed for each landing by an 09 aircraft that weights 6,000 pounds or more. This subsection does not apply to an 10 aircraft 11  (1) owned and operated, or leased and operated, by the state or the 12 United States; 13  (2) engaged in touch-and-go flight training; 14  (3) engaged in maintenance test flights;

01  (4) that after takeoff returns immediately to the same airport because 02 of mechanical, weather, or other precautionary reasons; 03  (5) that lands or takes off from a body of water within the boundaries 04 of the airport; 05  (6) that is a helicopter, except a helicopter with a certificated maximum 06 gross takeoff weight of 6,000 pounds or more; or 07  (7) that is engaged in nonrevenue flights required by the Federal 08 Aviation Administration for pilot training or air route approval. 09  (b) For purposes of this section, an aircraft's certificated maximum gross 10 takeoff weight must be rounded up to the next higher 1,000 pound level. 11  (c) The department shall adopt regulations to implement this section. 12 * Sec. 2. This Act takes effect July 1, 1999.
