00CS FOR SENATE BILL NO. 32(FIN) am 01 "An Act making and amending appropriations and reappropriations; making and 02 amending appropriations under art. IX, sec. 17(c), Constitution of the State of 03 Alaska, from the constitutional budget reserve fund; and providing for an 04 effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. ALASKA CLEAN WATER FUND. The sum of $9,649,500 is appropriated 07 to the Alaska clean water fund (AS 46.03.032) for the Alaska clean water loan program from 08 the following sources: 09 General fund match $ 1,608,300 10 Federal receipts 8,041,200 11 * Sec. 2. ALASKA DRINKING WATER FUND. The sum of $8,956,600 is appropriated 12 to the Alaska drinking water fund (AS 46.03.036) for the Alaska drinking water loan program 13 from the following sources: 14 General fund match $ 1,492,800

01 Federal receipts 7,463,800 02 * Sec. 3. ALASKA INDUSTRIAL DEVELOPMENT AND EXPORT AUTHORITY. The 03 sum of $18,000,000 from the available unrestricted cash in the Alaska Industrial Development 04 and Export Authority revolving fund (AS 44.88.060) is anticipated to be transferred to the 05 general fund as directed by the Alaska Industrial Development and Export Authority. The 06 transferred money shall be deposited in the general fund when received during fiscal year 07 2000. 08 * Sec. 4. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 09 $13,150,000 is appropriated from corporate receipts of the Alaska Housing Finance 10 Corporation to the municipal capital project matching grant fund (AS 37.06.010(b)) in the 11 Department of Administration to provide grants to municipalities under the municipal capital 12 project matching grant program. 13 (b) The sum of $1,850,000 is appropriated from corporate receipts of the Alaska 14 Housing Finance Corporation to the unincorporated community capital project matching grant 15 fund (AS 37.06.020(b)) in the Department of Community and Regional Affairs to provide 16 grants to unincorporated communities under the unincorporated community capital project 17 matching grant program. 18 (c) An amount equal to the interest earned on money in the individual grant accounts 19 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the unincorporated 20 community capital project matching grant fund (AS 37.06.020(b)) is appropriated from the 21 general fund to the respective funds. The interest is calculated using the average percentage 22 interest rate received by other accounts in the state's general investment fund that received 23 interest during fiscal year 1999. The appropriations made by this subsection are allocated pro 24 rata to each individual grant account based on the balance of the account on the close of 25 business on June 30, 1999. 26 * Sec. 5. CAPITAL PROJECT MATCHING GRANTS FOR MUNICIPALITIES. (a) 27 Subject to the conditions set out in (b) of this section, the sum of $1,438,819 is appropriated 28 from the appropriate individual grant accounts in the municipal capital project matching grant 29 fund (AS 37.06.010) to the Department of Administration for payment as grants under 30 AS 37.06.010 to the following municipalities in the amounts and for the purposes stated: 31 Akhiok Community facilities and equipment $ 30,899

FEDERAL AND OTHER PROGRAM RECEIPTS. (a) Federal receipts, 09 designated program receipts as defined under AS 37.05.146(b)(3), and receipts of commercial 10 fisheries test fishing operations under AS 37.05.146(b)(4)(U) that exceed the amounts 11 appropriated by this Act are appropriated conditioned on compliance with the program review 12 provisions of AS 37.07.080(h). 13 (b) If federal or other program receipts as defined in AS 37.05.146 exceed the 14 estimates appropriated by this Act, the appropriations from state funds for the affected 15 program may be reduced by the excess if the reductions are consistent with applicable federal 16 statutes. 17 (c) If federal or other program receipts as defined in AS 37.05.146 fall short of the 18 estimates appropriated by this Act, the affected appropriation is reduced by the amount of the 19 shortfall in receipts. 20 * Sec. 8. RURAL ELECTRIFICATION REVOLVING LOAN FUND. Notwithstanding 21 AS 42.45.020(g), the balance of the rural electrification revolving loan fund (AS 42.45.020) 22 on June 30, 1999, is appropriated to the Department of Community and Regional Affairs for 23 the electrical emergencies program. 24 * Sec. 9. KODIAK LAUNCH COMPLEX. (a) Subject to (b) of this section, the balance 25 of the earnings reserve of the Alaska science and technology endowment (AS 37.17.020(a)), 26 not to exceed $6,000,000, is appropriated from the earnings reserve to the Alaska Science and 27 Technology Foundation for payment as a grant under AS 37.17.090(k)(1) to the Alaska 28 Aerospace Development Corporation for completion of construction and the initial startup 29 costs of the Kodiak Launch Complex and for the commercialization of the facility. 30 (b) The appropriation made by (a) of this section is contingent on 31 (1) enactment in 1999 of an amendment of AS 37.17.090(k) to permit a grant

01 of $6,000,000; and 02 (2) approval of the board of directors of the Alaska Science and Technology 03 Foundation. 04 * Sec. 10. FISH AND GAME FUND. That portion of the revenue derived from the sale 05 of crewmember fishing licenses during the fiscal year ending June 30, 2000, that is not 06 appropriated for payment of compensation to agents under AS 16.05.470 and that is not 07 deposited into the fishermen's fund under AS 23.35.060 is appropriated to the fish and game 08 fund (AS 16.05.100). 09 * Sec. 11. FISH AND GAME FUNDING SOURCE. The source of the "other funds" 10 funding source for the appropriation made by sec. 31, ch. 137, SLA 1998, page 32, line 20 11 (Administration and Support - $6,088,500) is amended to delete $60,000 from Interagency 12 receipts and to add $60,000 from federal receipts. 13 * Sec. 12. DEPARTMENT OF NATURAL RESOURCES. The unexpended and 14 unobligated balance of the appropriation made in sec. 9, ch. 139, SLA 1998 (DNR appraisal 15 of public school lands - $432,525) is reappropriated for the fiscal year ending June 30, 2000, 16 to the Department of Natural Resources for an appraisal of public school lands to determine 17 the fair market value of the public school trust land where the land was redesignated as 18 general grant land in 1978. 19 * Sec. 13. GRANT TO ARCTIC POWER. The sum of $250,000 is appropriated from 20 the general fund to the Department of Community and Regional Affairs for payment as a grant 21 under AS 37.05.316 to Arctic Power for education efforts to open the coastal plain of the 22 Arctic National Wildlife Refuge for oil and gas exploration and development. 23 * Sec. 14. KETCHIKAN TREATMENT FACILITY. The sum of $200,000 is appropriated 24 from statutory designated program receipts to the Department of Health and Social Services 25 for construction of a regional youth/residential diagnostic treatment facility in Ketchikan. 26 * Sec. 15. PIONEERS' HOMES AND DEPARTMENT OF COMMUNITY AND 27 REGIONAL AFFAIRS. Section 6(f), ch. 2, SLA 1999, is amended to read: 28  (f) The unexpended and unobligated corporate receipts balances of the 29 appropriations made in sec. 10, ch. 4, FSSLA 1994, page 7, lines 30 - 31 (federal 30 competitive grants/public housing - $7,076,000) and sec. 10, ch. 4, FSSLA 1994, 31 page 7, line 32 (federal competitive grants - $4,953,000) are reappropriated to the

01 Department of Administration for boiler system replacement at the Fairbanks 02 Pioneers' Home. The [, AND THE] unexpended and unobligated corporate receipts 03 balance, not to exceed $588,664 [$676,834], of the appropriation made in sec. 10, 04 ch. 4, FSSLA 1994, page 7, line 34 (other competitive grants - $1,300,000) is [ARE] 05 reappropriated to the Department of Administration for boiler system replacement at 06 the Fairbanks Pioneers' Home. The unexpended and unobligated corporate receipts 07 balance, after the reappropriation of up to $588,664 for boiler system replacement 08 made by this section, of the appropriation made in sec. 10, ch. 4, FSSLA 1994, 09 page 7, line 34 (other competitive grants - $1,300,000) is reappropriated to the 10 Department of Community and Regional Affairs for state match of federal funds 11 from the United States Department of Commerce. 12 * Sec. 16. The sum of $566,000 is appropriated from interagency receipts of the 13 Department of Environmental Conservation from federal nonpoint source pollution funds to 14 the following departments for operating costs for the fiscal year ending June 30, 2000, in the 15 amounts and for the purposes stated: 16 DEPARTMENT AND PURPOSE APPROPRIATION AMOUNT 17 Department of Natural Resources, $121,000 18 division of forestry, for monitoring 19 the Forest Practices Act 20 Department of Fish and Game, habitat 284,000 21 division, for monitoring Best Management 22 Practices in cooperation with the division 23 of forestry in the Department of Natural 24 Resources 25 Department of Natural Resources, division of 66,000 26 forestry, for Tanana River dynamics 27 Department of Fish and Game, habitat division, 40,000 28 for identification of fish utilization areas of the 29 Tanana River in cooperation with the division 30 of forestry in the Department of Natural Resources 31 Department of Fish and Game, habitat division, 55,000

01 Best Management Practices for road and 02 stream crossings in the Tongass National 03 Forest. 04 * Sec. 17. HOPE COMMUNITY RESOURCES. The sum of $25,000 is appropriated from 05 the general fund to the Department of Health and Social Services for payment as a grant under 06 AS 37.05.316 to Hope Community Resources for a fire suppression sprinkler system. 07 * Sec. 18. ALASKA CENTER FOR THE BLIND. The sum of $34,500 is appropriated 08 from the general fund to the Department of Health and Social Services for payment as a grant 09 under AS 37.05.316 to the Alaska Center for the Blind for a fire suppression sprinkler system. 10 * Sec. 19. EXXON VALDEZ OIL SPILL RESTORATION FUND. (a) The legislature 11 finds that 12 (1) as a result of the judgment entered by the United States District Court in 13 the criminal case United States of America v. Exxon Shipping Company and Exxon 14 Corporation, No. A90-015 CR, the state received $50,000,000 in restitution "to be used by the 15 State of Alaska . . . exclusively for restoration projects, within the State of Alaska, relating 16 to the 'Exxon Valdez' oil spill"; 17 (2) the money received by the state in restitution is held in the "Exxon Valdez 18 oil spill restoration fund," established by the Department of Revenue, to implement the 19 judgment; and 20 (3) the appropriation in (b) of this section is made in order to achieve the 21 purposes in the court's restitution order. 22 (b) The sum of $215,000 is appropriated from the income accrued during the fiscal 23 year ending June 30, 2000, on the Exxon Valdez oil spill restoration fund described in (a) of 24 this section to the Department of Environmental Conservation for the Cordova Mile 17 landfill 25 construction. 26 * Sec. 20. DEPARTMENT OF ADMINISTRATION. The sum of $288,000 is appropriated 27 from the general fund to the Department of Administration in the following amounts and for 28 the following programs for increased operating costs for the fiscal year ending June 30, 1999: 29 PROGRAM APPROPRIATION AMOUNT 30 Alaska Oil and Gas Conservation $ 188,000 31 Commission

01 Longevity bonus grant program 100,000 02 * Sec. 21. CONSTITUTIONAL BUDGET RESERVE FUND. (a) Section 42(b), ch. 139, 03 SLA 1998, as amended by sec. 22, ch. 2, SLA 1999, is amended to read: 04  (b) If the unrestricted state revenue available for appropriation in fiscal year 05 1999 is insufficient to cover the general fund appropriations made for fiscal year 1999, 06 the amount necessary to balance revenue and general fund appropriations, not to 07 exceed $1,100,000,000 [$900,000,001], is appropriated to the general fund from the 08 budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska). 09 (b) If the unrestricted state revenue available for appropriation in fiscal year 2000 is 10 insufficient to cover the general fund appropriations made for fiscal year 2000, the amount 11 necessary to balance revenue and general fund appropriations, not to exceed $1,007,000,000, 12 is appropriated to the general fund from the budget reserve fund (art. IX, sec. 17, Constitution 13 of the State of Alaska). 14 * Sec. 22. (a) Section 53, ch. 100, SLA 1997, as amended by sec. 7, ch. 139, SLA 1998, 15 is amended to read: 16  Sec. 53. AMERICAN RED CROSS GRANT LAPSE EXTENSION. That 17 portion of the appropriation made in sec. 30, ch. 117, SLA 1996, page 39, line 8 18 (Department of Military and Veterans' Affairs for disaster planning and control - 19 $3,161,000) that was awarded by the department as a grant to the American Red Cross 20 lapses into the funds from which appropriated on June 30, 2000 [1999]. 21 (b) Section 8, ch. 139, SLA 1998, is amended to read: 22  Sec. 8. LAPSE EXTENSION OF FY 1998 AMERICAN RED CROSS 23 GRANT. That portion of the appropriation made in sec. 39, ch. 98, SLA 1997, page 24 41, line 17 (Department of Military and Veterans' Affairs for disaster planning and 25 control - $3,341,600) that was awarded by the department as a grant to the American 26 Red Cross lapses into the funds from which appropriated on June 30, 2000 [1999]. 27 * Sec. 23. MISCELLANEOUS CLAIMS. The following amounts are appropriated from 28 the general fund to the following departments to pay miscellaneous claims and stale-dated 29 warrants for the fiscal year ending June 30, 1999: 30 DEPARTMENT APPROPRIATION 31 Administration $ 2,423.29

01 Fish and Game 1,952.90 02 Law 1,189.20 03 * Sec. 24. EXPENSES RELATED TO THE BP AMOCO-ARCO MERGER. (a) The sum 04 of $100,000 is appropriated from the general fund to the Department of Law for costs 05 associated with the proposed BP Amoco - ARCO merger for the fiscal years ending June 30, 06 1999, and June 30, 2000. 07 (b) The sum of $100,000 is appropriated from the general fund to the Alaska 08 Legislative Council for costs associated with the proposed BP Amoco - ARCO merger for the 09 fiscal years ending June 30, 1999, and June 30, 2000. 10 * Sec. 25. DEPARTMENT OF LAW SUBMERGED LANDS LITIGATION. The sum of 11 $30,000 is appropriated from the general fund to the Department of Law for the costs of the 12 Glacier Bay/Tongass submerged lands quiet title litigation for the fiscal year ending June 30, 13 1999. 14 * Sec. 26. FEDERAL AND OTHER PROGRAM RECEIPTS FOR FISCAL YEAR 1999 15 CAPITAL BUDGET. (a) Federal receipts, designated program receipts as defined under 16 AS 37.05.146(b)(3), and receipts of commercial fisheries test fishing operations under 17 AS 37.05.146(b)(4)(U) that exceed the amounts appropriated by ch. 139, SLA 1998, are 18 appropriated conditioned on compliance with the program review provisions of 19 AS 37.07.080(h). 20 (b) If federal or other program receipts as defined in AS 37.05.146 exceed the 21 estimates appropriated by ch. 139, SLA 1998, the appropriations from state funds for the 22 affected program made by ch. 139, SLA 1998, may be reduced by the excess if the reductions 23 are consistent with applicable federal statutes. 24 (c) If federal or other program receipts as defined in AS 37.05.146 fall short of the 25 estimates appropriated by ch. 139, SLA 1998, the affected appropriation made in ch. 139, SLA 26 1998, is reduced by the amount of the shortfall in receipts. 27 * Sec. 27. DEPARTMENT OF LAW GLACIER BAY LITIGATION. The sum of 28 $200,000 is appropriated from the general fund to the Department of Law for the expenses 29 of litigation related to title to submerged land and jurisdiction over marine waters within 30 Glacier Bay and Southeast Alaska. 31 * Sec. 28. DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES. (a)

01 If sec. 36 of this Act has not taken effect under sec. 32(b) of this Act before July 1, 2000, sec. 02 36 of this Act is repealed on July 1, 2000. 03 (b) If sec. 38 of this Act has not taken effect under sec. 32(c) before July 1, 2000, 04 sec. 38 of this Act is repealed on July 1, 2000. 05 (c) If sec. 40 of this Act has not taken effect under sec. 32(d) before July 1, 2000, 06 sec. 40 of this Act is repealed on July 1, 2000. 07 * Sec. 29. LAPSE PROVISIONS. (a) The appropriations made by secs. 1, 2, 4, and 10 08 of this Act are for capitalization of funds and do not lapse under AS 37.25.010. 09 (b) The appropriations made by secs. 8, 9, 13 - 15, and 17 - 19, are for capital 10 projects and lapse under AS 37.25.020. 11 * Sec. 30. CONSTITUTIONAL BUDGET RESERVE VOTING NOTICE. The 12 appropriations made and amended by sec. 21 of this Act are made under art. IX, sec. 17(c), 13 Constitution of the State of Alaska. 14 * Sec. 31. RETROACTIVITY. Section 26 of this Act is retroactive to July 1, 1998. 15 * Sec. 32. EFFECTIVE DATES. (a) Sections 11, 12, 15, 20, 21(a), 22 - 26 and 35 - 37 16 of this Act take effect immediately under AS 01.10.070(c). 17 (b) Section 36 of this Act takes effect on the day after the Anchorage Metropolitan 18 Area Transportation Study policy committee authorizes the commissioner of transportation and 19 public facilities to publish public notice of a proposal to amend the Statewide Transportation 20 Improvement Plan to incorporate all the projects included in sec. 36 of this Act. The 21 commissioner of transportation and public facilities shall immediately notify the lieutenant 22 governor and the revisor of statutes when the notice is published. 23 (c) Section 38 of this Act takes effect on the day after the commissioner of 24 transportation and public facilities publishes public notice of a proposal to amend the 25 Statewide Transportation Improvement Plan to incorporate the projects included in sec. 38 of 26 this Act. The commissioner of transportation and public facilities shall immediately notify the 27 lieutenant governor and the revisor of statutes when the notice is published. 28 (d) Section 40 of this Act takes effect on the day after the commissioner of 29 transportation and public facilities publishes public notice of a proposal to amend the 30 Statewide Transportation Improvement Plan to incorporate the projects included in sec. 40 of 31 this Act. The commissioner of transportation and public facilities shall immediately notify the
