00CS FOR SENATE BILL NO. 27(FIN) am H 01 "An Act relating to school records and driver license records of certain children." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 14.03 is amended by adding a new section to read: 04  Sec. 14.03.115. Access to school records by parent, foster parent, or 05 guardian. Upon request of a parent, foster parent, or guardian of a child under 18 06 years of age who is currently or was previously enrolled in a municipal school district 07 or a school district that is a regional educational attendance area, the school district 08 shall provide a copy of the child's record. This section does not apply to 09  (1) a record of a child who is an emancipated minor; or 10  (2) record information that consists of the child's address if the school 11 district determines that the release of the child's address poses a threat to the health or 12 safety of the child. 13 * Sec. 2. AS 14.30.710 is amended to read: 14  Sec. 14.30.710. Required records upon transfer. Within 14 days after

01 enrolling a child as a transfer student from this or another state in an elementary or 02 secondary school, the school or school district shall request directly from the child's 03 previous school a certified copy of the child's record. An elementary or secondary 04 school or a school district in this state requested to forward a copy of a transferring 05 child's record to another school shall comply with the request within 10 days after 06 receiving the request unless the record has been flagged under AS 14.30.700. Upon 07 receipt of a request for a record that has been flagged, the school or school district 08 shall immediately notify the Department of Public Safety. Unless directed to do so by 09 the Department of Public Safety, a school or a school district may not forward a copy 10 of a flagged record. In this section, "record" includes information about the 11 child's commission of an offense that is punishable as a felony or that involved the 12 use of a deadly weapon, as that term is defined in AS 11.81.900(b). 13 * Sec. 3. AS 28.15.151(c) is amended to read: 14  (c) The department shall, upon request, subject to the applicable provisions of 15 AS 12.62 and (f) of this section and without charging a fee, furnish (1) a municipal, 16 state, or federal administrative or judicial agency with a certified abstract of the driving 17 record of a driver ; and (2) a parent, foster parent, or guardian of a driver who is 18 under 18 years of age and not an emancipated minor an abstract of the driving 19 record of that driver; the department may refuse to release the driver's address 20 to the parent, foster parent, or guardian if the department determines that the 21 release of the driver's address poses a threat to the health or safety of the driver . 22 The abstract must include a listing of accidents in which the driver has been 23 determined by the department or a court of competent jurisdiction to have been liable, 24 convictions of vehicle, driver, and traffic offenses, any actions taken upon the driver's 25 license, and information relating to financial responsibility.
