00SENATE BILL NO. 26                                                                                                    
01 "An Act relating to providing false information or reports to a peace officer."                                         
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
03    * Section 1.  AS 11.56 is amended by adding a new section to read:                                                 
04  Sec. 11.56.795. False information or report in the first degree.  (a)  A                                            
05 person commits the crime of false information or report in the first degree if the                                      
06 person knowingly gives false information concerning the person's identity to a peace                                    
07 officer while that person is under arrest or detention for a felony or being served a                                   
08 warrant for a felony offense.                                                                                           
09  (b)  False information or report in the first degree is a class C felony.                                             
10    * Sec. 2.  AS 11.56.800 is amended to read:                                                                        
11  Sec. 11.56.800.   False information or  [MAKING A FALSE] report  in the                                              
12 second degree .  (a)  A person commits the crime of [MAKING A] false  information                                     
13 or  report  in the second degree  if the person knowingly                                                            
14   (1)  gives false information                                                                                         

01    (A)   to a peace officer with the intent of implicating another in                                               
02 a crime;  or                                                                                                           
03   (B)  concerning the person's identity to a peace officer while                                                      
04 the person is                                                                                                           
05   (i)  under arrest or detention for a misdemeanor or                                                                
06 being served a warrant for an offense other than a felony; or                                                           
07   (ii)  being issued a citation;                                                                                    
08   (2)  makes a false report to a peace officer that a crime has occurred or                                            
09 is about to occur;                                                                                                      
10   (3)  makes a false report or gives a false alarm that a fire or other                                                
11 incident dangerous to life or property calling for an emergency response has occurred                                   
12 or is about to occur; or                                                                                                
13   (4)  makes a false report to the Department of Natural Resources under                                               
14 AS 46.17 concerning the condition of a dam or reservoir.                                                                
15  (b)  False information or  [MAKING A FALSE] report  in the second degree                                          
16 is a class A misdemeanor.
