00SENATE BILL NO. 8 01 "An Act relating to the number of toilets in women's restrooms in certain 02 facilities." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.35.120 is amended to read: 05  Sec. 18.35.120. Enforcement of AS 18.35.100. The department shall adopt 06 regulations to implement and enforce AS 18.35.100 by appropriate means. The 07 regulations must set standards of sanitation and must provide for, but need not be 08 limited to, periodic inspections. However, except as required by AS 18.35.240, the 09 regulations may not require a restaurant or tavern to have more than one toilet 10 accommodation. 11 * Sec. 2. AS 18.35 is amended by adding a new section to read: 12  Sec. 18.35.240. Required number of toilets in women's restrooms. (a) 13 Notwithstanding any other provision of law, the owner of a facility designed and 14 constructed on or after the effective date of this section in which events are held that

01 are open to members of the public and that has a capacity of more than 100 persons 02 shall make available in the facility to the women attending an event at least one and 03 one-half times the number of toilets that are available in the facility to the men 04 attending the event. 05  (b) A person who knowingly violates (a) of this section is guilty of a class C 06 misdemeanor. 07  (c) The Department of Environmental Conservation may adopt regulations to 08 implement and enforce this section. 09  (d) In this section, 10  (1) "facility" means a private, governmental, or other structure, 11 including a performing arts theater, an arena, and a convention center, but does not 12 include a structure controlled by a judicial branch of government; 13  (2) "owner" means, with respect to a facility owned by the state or the 14 federal government, the state or federal agency that operates the facility; 15  (3) "person" includes a government or a governmental instrumentality.
