01 "An Act relating to workers' compensation; and providing for an effective date."                                        
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
03    * Section 1.  AS 23.30.080 is amended by adding a new subsection to read:                                          
04  (e)  If an employer fails to insure or provide security as required by                                                
05 AS 23.30.075, the board shall require the employer to pay to the employee a penalty                                     
06 equal to 50 percent of the compensation due under this chapter.                                                         
07    * Sec. 2.  AS 23.30.155(o) is amended to read:                                                                     
08  (o)  If  [THE BOARD SHALL PROMPTLY NOTIFY THE DIVISION OF                                                           
09 INSURANCE IF] the board determines that the employer's insurer has frivolously or                                       
10 unfairly controverted compensation due under this chapter , the board shall promptly                                   
11 notify the division of insurance and shall require the employer to pay the                                              
12 employee a penalty equal to 50 percent of the compensation due under this                                               
13 chapter .  After receiving notice from the board, the division of insurance shall                                      
14 determine if the insurer has committed an unfair claim settlement practice under                                        

01 AS 21.36.125.                                                                                                           
02    * Sec. 3.  This Act takes effect July 1, 2000.
